The District understands and agrees that the Contractor acts and performs as an independent contractor of the District at all times. Accordingly, nothing in this Agreement shall permit the District to exercise control or direction over the means or methods by which the Contractor performs the services for which it has have been engaged.
It is the intent of the DCPS to award two separate contracts, one for routine tree trimming and removal and one for emergency tree trimming and removal. Contracts for routine and emergency tree service may be awarded to a PRIMARY contractor, a SECONDARY contractor and a TERTIARY contractor for routine tree trimming and removal and emergency tree trimming and removal.

Services that the City is seeking include nurseries, tree installation and initial care and irrigation, tree maintenance including emergency and routine tree pruning and young tree training, and tree removals. All vendors will act as an extension of City staff and must conduct themselves according to City employee expectations. Agreement term: The initial term of the agreement shall be five (5) years.
