NOTICE OF INTENT TO SOLE SOURCE The Department of Veterans Affairs, Veterans Integrated Service Network (VISN 5), Washington DC VA Medical Center located at 50 Irving St NW, Washington DC, 20422 is issuing this Notice of Intent (NOI) to inform industry contractors of the Government s intent to execute a Sole Source award under the authority of FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement and only one responsible source and no other supplies or services will satisfy agency requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1. This is for the reagents and consumables to perform routine flow cytometry assays on a VA owned FACSCanto II flow cytometer (SN: V96100771) with automated loader (SN: F06500621). The

FACSCanto with automated loader currently owned by the VA is manufactured by BD Biosciences Immunocytometry Systems. BD Bioscience is the exclusive manufacturer and supplier of the BD FACSCanto, instrument, and reagents. BD do not have authorized distributors in the United States for these products. The place of performance is Washington DC VAMC, 50 Irving St NW, Washington DC, 20422. This action will result in a Firm-Fixed Price Contract. The intended Contractor is Becton, Dickinson and Company located at 2350 Qume Dr, San Jose, CA 95131 USA The North American Industry Classification System (NAICS) for this requirement is, 334516, Analytical Laboratory Instrument Manufacturing - Product of Service Code for this requirement is 6640, Laboratory Equipment, and Supplies. The Small Business Administration (SBA) size standard for this sector is 1,000. This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. No award will be made based on unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling, and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government. The Government anticipates the award of a firm-fixed- price contract.
