NOTICE TO BIDDERS (Chapter 103D, HRS) Disadvantaged Business Enterprise ELECTRONIC SEALED OFFERS for the Furnishing and Paying for all materials, labor, transportation, tools, equipment, machinery and services necessary to construct in place and complete: OLOHENA ROAD (RTE 581) IMPROVEMENTS, FEDERAL-AID PROJECT NO. STP-0700(085), DISTRICT OF KAWAIHAU, ISLAND OF KAUAI, will be received via the Public Purchase System and recorded immediately for the Division of Purchasing, Department of Finance, until 3:00 P.M. HST, on March 10 , 2023 . Bidders are further notified of the requirements of Act 190, SLH 2011, SB 758, wherein the County of Kaua‘i is required to utilize the Hawai‘i Compliance Express (HCE) to obtain proof of compliance with tax, registration, and labor requirements prior to the issuance of an award. Bidders are strongly encouraged to register via HCE to allow for needed proof of compliance prior to the issuance of an award (HRS 103D-328, HRS 103D-310, HAR 3-122-112). The
project includes rehabilitation of Hot Mix Asphalt pavement; resurfacing of Hot Mix Asphalt pavement; constructing Precast Plank Bridge and paved shoulders; removing existing pavement, headwall, fence, and trees; installing retaining walls, guardrails, attenuators, Portland cement concrete and Hot Mix Asphalt driveways, signs, geotextiles, and pavement markings; modifying drainage system culverts, frames, grates, and headwalls; adjusting utilities; cleaning existing culverts; cold planing; erosion control; and traffic control. Contractors interested in accessing and responding to Invitation For Bid (IFB) Document No. 3859 , assigned by the Division of Purchasing must be registered as a Public Purchase Vendor, Hawaii Region, and Kauai County Agency. New Vendors should click on the link to Public Purchase provided on the www.kauai.gov webpage or go to www.publicpurchase.com to initiate the registration process. Bids shall be submitted via the Public Purchase System. To be eligible to bid, bidders must possess a valid State of Hawaii General Engineering Contractor’s “A” license, prior to the award of the contract. The U.S. Department of Transportation Regulation entitled “Nondiscrimination in Federally-Assisted Programs of the U.S. Department of Transportation,” Title 49, Code of Federal Regulations (CFR), Part 21 is applicable to this project. Bidders are hereby notified that the Department of Transportation will affirmatively ensure that the contract entered into pursuant to this advertisement will be awarded to the lowest responsible bidder without discrimination on the grounds of race, color, national origin, or sex (as directed by 23 CFR Part 200). The Equal Employment Opportunity Regulations of the Secretary of Labor implementing Executive Order 11246 shall be complied with on this project. The U.S. Department of Transportation Regulations entitled "Participation by Disadvantaged Business Enterprise in Department of Transportation Programs", Title 49, Code of Federal Regulations, Part 26 is applicable to this project. Bidders are hereby notified that the Department of Transportation will strictly enforce full compliance with all of the requirements of the Disadvantaged Business Enterprise (SBE) program with respect to this project. Bidders are directed to read and be familiar with the Disadvantaged Business Enterprise (DBE) Requirements, which establishes the program requirements pursuant to Title 49 Code of Federal Regulations Part 26 and, particularly, the requirements of certification, method of award, and evidence of good faith.
