href="mailto:kimberly.hunt-brown@state.nm.us">kimberly.hunt-brown@state.nm.us Specifications: The State of New Mexico, Energy, Minerals and Natural Resource Department (EMNRD) State Parks Division is seeking a supplier to provide and deliver zoo animal food products on an as-needed basis as listed in this ITB to the Living Desert Zoo and Gardens, in Carlsbad, NM. Term: The term of this agreement shall be for one (1) year from the date of award with the option to extend for a period(s) of three (3) additional years, on a year-by-year basis, by mutual agreement of all parties and approval of the State of New Mexico Purchasing Director at the same price, terms and conditions. This agreement shall not exceed four (4) years. Multiple Awards: Pursuant to the Procurement Code, Sections 13-1-153 and 13-1-154, the State reserves the right to issue multiple awards to obtain the items listed. Multiple awards are recommended to ensure availability and timely delivery. Determination for award shall be based upon the lowest total cost of all items listed and the bidders abilities to meet the "minimum and submittal requirements of the ITB. This may be a multiple award contract. Awards will be made to meet the best interests of the State of New Mexico. Compensation: The prices quoted herein represent the total compensation to be paid by the State for the goods and/or services provided including any and all labor, equipment, tools, materials, taxes, permits, licenses, or other costs necessary to complete the service or goods provided. Tax Note: Price shall not include state gross receipts tax or local option tax. Such tax or taxes shall be added at time of invoicing at current rate, and shown as a separate item to be paid by user. Shipping Note: When applicable, freight shall be prepaid by the Awarded Vendor(s) and the cost shall be added to the invoice by the Awarded Vendor(s) as a separate item to be reimbursed by the State. Delivery: Supplier shall deliver all products in accordance with the requirements of this ITB, and FOB Destination to: Living Desert Zoo and Garden 1504 Skyline Drive Carlsbad, NM 88220 Deliveries shall be made between the hours of 8 a.m. to 5 p.m. Shipping Cost or Freight shall not be included in pricing but shall be listed separately on the submitted invoice. Name Brand or Equivalent: EMNRD State Parks Division does not require a specific name brand to be used or furnished in fulfillment of the requirements in this ITB. Any use of a name brand in this ITB is only for establishing a standard of comparison in performance or manufacture, and may not be used to restrict competition. Bidders may offer name brand or an equivalent to the name brand. Bidding Information: The conditions and specifications set out in this ITB are inseparable and indivisible. Any Bidder, by submitting a bid, agrees to be bound by all such conditions and/or specifications. All conditions and specifications in the ITB, and all other documents required to be submitted, shall be submitted by the Bidder in their bid package. Failure to do so or any attempt to vary or change the conditions or specifications of the invitation to bid shall, at the discretion of the State of New Mexico, constitute grounds for rejection of the entire bid. The prices quoted herein represent the total compensation to be paid by the State of New Mexico for goods and/or services provided. It is understood that the vendor providing said goods and/or services to the State of New Mexico is responsible for payment of all costs of labor, equipment, tools, materials, federal taxes, permits, licenses, fees, and any other items necessary to complete the work provided. The prices quoted in this price agreement include an amount sufficient to cover such costs. When bidding, enter the amounts for the respective bid item unit prices to a maximum of three (3) decimal places. Any Awarded Vendor shall be considered an independent Contractor and not an employee of the State of New Mexico. The Agency shall provide direction regarding the time and place of performance and compliance with rules and regulations required by this price agreement. Escalation/Reduction Clause: Contractor shall keep pricing fixed for the first year of this Agreement. Thereafter, SPD and the Contractor may adjust pricing no more than once annually through an amendment to the Agreement at the time of Agreement renewal. Contractor shall submit all pricing increase Description requests to SPD directly or through the agency contact in writing and provide substantiating evidence that each request is based on demonstrable market changes impacting the cost of products. The request must show all proposed increases by line item and include supporting documentation acceptable to SPD (such as a letter from a manufacturer indicating price increases, etc.) SPDs decision on what is acceptable in this context is final and shall be accepted by all parties to the Agreement. Requested price increases that exceed 10% will not be accepted. No price increase may result in a higher profit margin for the Contractor than at the beginning of the initial term of this Agreement. Pricing changes will apply to Agreements and amendments to Agreements entered on and after the effective date of the price change. Price decreases as well as increases shall apply in the same manner. If vendor's prices are reduced for any reason, users shall receive the benefit of such reductions, immediately. Price increases will not be retroactive to orders already in house or backorders. Orders will be filled at the price in effect on the date of receipt of the order by the vendor. Hold Harmless Clause: Contractor shall indemnify and hold harmless the State, its officers, and employees, against liability, claims, damages, losses, or expenses arising out of bodily injury to persons or damage to properties caused by, or resulting from, Contractor's and/or its employees, own negligent acts or omissions while Contractor, and/or its employees perform or fail to perform its obligations and duties under the terms and conditions of this Price Agreement. This Save Harmless and Indemnification Clause is subject to the immunities, provisions, and limitations of the Tort Claims Act (Section 41-4-1, et seq., NMSA 1978 Comp. and Section 56-7-1 NMSA 1978 Comp.) and any amendments thereto. It is specifically agreed between the parties executing this Price Agreement that it is not intended by any of the provisions of any part of the Price Agreement to create the public or any member hereof a third party beneficiary or to authorize anyone not a party to the Price Agreement to maintain a suit for wrongful death, bodily and/or personal injury to persons, damage to properties and/or other claims whatsoever pursuant to the provisions of this Price Agreement. Minimum Requirements: 1. Scope of Work: 1. The Supplier shall provide a complete and balanced mixed carnivore ration with appropriate vitamin/mineral supplementation. 1. The Supplier shall supply beef and/or horsemeat only (no pork, chicken or other). 2. The Supplier shall operate out of a United States Department of Agriculture (USDA) inspected facility and have USDA (or Canadian equivalent) inspected raw ingredients for horse meat. 3. The Supplier shall have documented, comprehensive Hazard Analysis and Critical Control Points (HACPP) Program In place (food safety). 4. Product provided shall not contain any ingredients from animals or carcasses designated as 3D or 4D meat sources by an agent of Food Safety and Inspection Services. This refers to the original source of beef; 3D/4D refers to diseased, down, dead, dying cattle used. 5. The supplier shall have a routine microbial culture testing (for equipment and product), testing can be in-house or sent out. Testing shall be performed at least twice a month for E. coli, total plate count, coliform count, salmonella, and staph. 6. The supplier is required to have fixed formulations. 7. The supplier shall consult with experienced zoo/expert nutritionist for all formula changes, etc. 8. The supplier shall perform nutrient analysis during and after production, to include proximate and fat, minerals, and weekly in house and outsourced analysis of moisture, protein, fat, and ash. 2. Meat shall be fresh and processed in USDA inspected plants under strict sanitary conditions, stored at freezer temperatures of 0 degrees Fahrenheit or below. Products shall be maintained in such frozen state until delivered to the zoo. Product shall meet all-Natural Resource Commission (NRC) and Association Feed Control Officials (AAFCO) requirements. 1. Ingredient Source: 1. Horsemeat or beef from cutter/canner grades of horse or cattle, or trimmings from any portion of carcasses from other grades that yield a meat by-product shall be used. 1. All bones, cartilage, backstrap, heavy connective tissue, and lymph glands shall be removed. 2. Used of stored ground product is not permitted. 3. Trimmings from automatic deboning machines and advance lean retrieval systems shall be excluded. 4. Fresh ingredients shall not be derived from meat which has been previously frozen. 2. All meat and meat products shall originate from animals slaughtered in establishments operated under Meat and Poultry Inspection Operations (MPIO) regulations of the Food Safety and Inspection Service (FSIS), or under a system of meat inspection approved by FSIS. 1. Ingredients: 1. Diets: 1. Classic Carnivore Diet 1. A Classic Carnivore Diet shall be used to feed felines, canines, and birds of prey under most normal circumstances, and unless otherwise determined by the zoos veterinarian. 2. The Classic Carnivore Diet shall be close in composition to the following ingredients: horse meat, meat, meat-products, fish meal, soybean meal, dried beet pulp, Calcium Carbonate, Dicalcium Phosphate, dried egg, brewers dried yeast, salt, Vitamin Premix (Choline Chloride, Vitamin E supplement, Niacin, Vitamin B-12 Riboflavin, Folic Acid, Vitamin A Acetate, Thiamine Mononitrate, D- Calcium Pantothenate, mineral oil, Biotin, Pyridoxine Hydrochloride, Vitamin D- 3 supplement), Taurine, Trace Mineral Premix (Zinc Oxide, Manganous Oxide, Copper Oxide, mineral oil, Sodium Selenite, Calcium Iodate). 3. See Items List: Feline, Items 1 through 5; Canine, Items 26 through 30; Birds of Prey, Items 34 through 37. 1. Premium Carnivore Diet 1. A Premium Carnivore Diet shall be used to feed felines and canines under conditions determined appropriate by the zoos veterinarian. 2. Premium Carnivore Diet shall be close in composition to the following ingredients: horse meat, powdered cellulose, Dicalcium Phosphate, Calcium Carbonate Vitamin Premix (Roughage Products, Vitamin E Supplement, mineral oil, Niacin supplement, Biotin, Menadione Sodium Bisulfite Complex (source of Vitamin K activity), Vitamin A supplement, Riboflavin, Pyridoxine Hydrochloride, Folic Acid, Calcium Pantothenate, Thiamine Mononitrate, Vitamin D-3 supplement) Trace Mineral Premix (Copper Sulfate, Manganese Sulfate, Ethylenediamine dihydrodide, Sodium Selenite), Choline Chloride, Taurine, salt. 3. See Items List: Feline, Items 6 through 10; Canine, Items 31 through 33. 2. Classic Beef Diet and Premium Beef Diet 1. The Classic Beef and Premium Beef diets shall be fed as directed by the zoos veterinarian to feline populations. 2. Both Classic and Premium Beef diets shall be close in composition to the following ingredients: beef, powdered cellulose, Dicalcium Phosphate, Calcium Carbonate, Vitamin Premix (Vitamin E supplement, Niacin, D-Biotin, Vitamin A Acetate, Riboflavin, Pyridoxine, Folic Acid, D- Calcium Pantothenate, Thiamine Mononitrate, Vitamin D-3 supplement, Menadione Sodium Bisulfate Complex (source of Vitamin K activity), Trace Mineral Premix (Zinc Oxide, Manganese Oxide, Copper Oxide, mineral oil, Sodium Selenite, Calcium Iodate), Choline Chloride, Taurine, salt. 3. The zoos veterinarian may also determine that a Senior Feline Diet is appropriate for certain felines in the animal population. 2. Premium Senior Feline Diet (Feline) shall be close in composition to the following ingredients: horse meat, hearts, powdered cellulose, dried egg, Calcium Carbonate, Dicalcium Phosphate, Vitamin Premix (Choline Chloride, Vitamin E supplement, Niacine, Vitamin B-12, Riboflavin, Folic Acid, Vitamin A Acetate, Tthiamine Mononitrate, D-Calcium Pantothenate, mineral oil, Biotin, Pyridoxine Hydrochloride, Vitamin D-3 supplement), fish oil, brewers yeast, salt, Taurine, Trace Mineral Premix (zinc oxide, Mangonous Oxide, Copper Oxide, mineral oil, Sodium Selenite, Calcium Iodate). 3.
