Description THIS IS A SOURCES SOUGHT SYNOPSIS FOR WRITTEN INFORMATION ONLY. THIS IS NOT A SOLICITATION ANNOUNCEMENT FOR PROPOSALS AND NO CONTRACT WILL BE AWARDED FROM THIS ANNOUNCEMENT. NO REIMBURSEMENT WILL BE MADE FOR ANY COSTS ASSOCIATED WITH PROVIDING INFORMATION IN RESPONSE TO THIS ANNOUNCEMENT AND ANY FOLLOW-UP REQUESTS. NO TELEPHONE CALLS REQUESTING A SOLICITATION WILL BE ACCEPTED OR ACKNOWLEDGED. Title: Technical Support and Program Management Services for the Office of Compliance. The Environmental Protection Agency (EPA) is performing “market research” to identify the capabilities of firms that can provide services to the Office of Compliance (OC). The OC serves as the principal advisor to the Assistant Administrator of Office of Enforcement and Compliance Assurance (OECA) on the implementation and oversight of activities related to compliance with environmental laws, including the Clean Air Act (CAA); Clean Water Act (CWA); Federal Insecticide, Fungicide and Rodenticide Act
(FIFRA); Resource Conservation and Recovery Act (RCRA); Safe Drinking Water Act (SDWA); Toxic Substances Control Act (TSCA); and Emergency Planning and Community Right-to-Know Act (EPCRA). In coordination with the agency program offices, the OC serves as the national technical expert on all matters relating to media program compliance activities and is responsible for designing and implementing compliance assurance programs, including environmental problem and/or sector-oriented programs. OC works with other OECA offices, programs, regions, states, localities, and tribes to address and enhance regulatory compliance among all segments of the regulated community. OC is the OECA lead for compliance and enforcement strategic planning and targeting processes and provides policy and interpretive guidance, direction, and oversight to Regional, State, Local, and Tribal enforcement programs on national program priorities. To be considered a potential source, a firm must demonstrate they are able to provide the necessary personnel and services to support the efforts delineated by the Draft Performance Work Statement. Specific services required will be identified in individual task orders issued by the Contracting Officer and includes the following Six (6) task areas: Task Area I. Trainings and Other Events. Task Area II. Targeting and Data Analysis/Management. Task Area III. Compliance Monitoring Support. Task Area IV. Compliance Assurance. Task Area V. Outreach; and Task Area VI. Planning, Measurement, Program Management and Analysis Support. The successful contractor shall provide all necessary labor, materials, and services in support of the efforts. A draft copy of the PWS is included as an attachment. Interested parties with the capability of providing any of the services described in the draft PWS posted are invited to submit capability documents with sufficient information that clearly demonstrates their ability to provide the services described in the draft PWS. A description of similar services previously or currently provided shall be submitted. Standard company brochures will not be considered a sufficient response to this Sources Sought Synopsis. Due to the nature of the work, there are potential situations where organizational conflict of interest (OCOI) could occur during the life of the contract. Of particular concern are contractors that serve both government and non-government clients. In some cases, these firms may assist their private clients in complying with Federal and state requirements. If a business is part of the regulated community (which is any business covered by a statute administered by the EPA, such as the Clean Air Act (CAA); Clean Water Act (CWA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Resource Conservation and Recovery Act (RCRA); Safe Drinking Water Act (SDWA); Toxic Substances Control Act (TSCA); and Emergency Planning and Community Right-to-Know Act (EPCRA)., etc., the contractor could be assisting EPA on the same matter it is assisting a private client; and this type of assistance could result in a potential conflict of interest. OCOI controls will be applied on a case-by-case basis as specific projects affecting particular companies, industries, or facilities as they are identified. The contract clause LIMITATION OF FUTURE CONTRACTING, (1552.209-74) ALTERNATE V (HEADQUARTERS SUPPORT) (APR 2004), will also be included in the resultant contract. Under paragraph (c) of said clause will include the following restriction: “the Contractor, during the life of the contract, unless prior written approval is obtained from the cognizant EPA Contracting Officer, 1) shall not enter into a contract with owners or operators of facilities that may be impacted by enforcement and compliance activities, performed under an Order of the resulting BPA, as regulated parties under the Clean Water Act (CWA); Safe Drinking Water Act (SDWA; Clean Air Act (CAA); Resource Conservation and Recovery Act (RCRA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Toxic Substance Control Act (TSCA); and the Emergency Planning and Community Right-to-Know Act (EPCRA), (2) shall not act as a consultant to any such regulated parties that may be impacted by enforcement and compliance activities performed under Orders of the resulting BPA; or 3) shall not enter into a contract with private entities that have a financial interest in or a business relationship with any such regulated parties or are otherwise stakeholders in some aspect of the EPA’s Office of Compliance Programs.” It is anticipated that the resulting contracts will be multiple award IDIQ contracts (under FAR Part 15) with a five-year ordering period with a target effective date of May 1, 2023. The anticipated contract will also include an option to extend services for up to six months. The contract is expected to have a minimum order amount of $100,000 and a ceiling of $31,000,000. Task Order issued against the IDIQ are anticipated to be Firm Fixed Priced and Cost-Plus Fixed Fee (Term and Completion) Type Task Orders or a combination thereof. The applicable NAICS code is 541620 Environmental Consulting Services, the size standard is $16.5 Million. The capability statement’s information should include: Size status for the above referenced NAICS code, (i.e. large, small) and whether or not they are a certified Hubzone, 8(a), women-owned, small disadvantaged and/or service disabled veteran owned small business concern, point of contact, telephone number, email and interest in proposing on the solicitation when issued. The EPA reserves the right to set this action aside for small businesses if it determines that there are two or more small businesses able to compete in terms of market prices, quality, and delivery. If set aside, for a small business, at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern (FAR 52.219-14 Limitations on Subcontracting (MAR 2020)). Capability statements from small businesses should address their ability to meet this requirement. Capabilities Statements in response to this Sources Sought Synopsis MUST BE SUBMITTED THROUGH THE FEDCONNECT PORTAL MESSAGE CENTER by December 15, 2022, at 15:00 Hours ET. A separate synopsis will be issued for the Request for Proposal (RFP) resulting from this sources sought synopsis.
