Notice of Intent to Sole Source - Davit Winch - Pisces

NOTICE OF INTENT TO SOLE SOURCE NOAA's Marine Operations Center, Acquisitions Branch, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Palfinger Marine USA Inc, of New Iberia, Louisiana, for the purchase of one (1) each NB3412-W50RS Winch for NOAA Ship Pisces as direct replacement for a failed unit. The sole source determination is based on the requirement for OEM direct replacement fo the failed unit. Palfinger Marine is the OEM and retains the proprietary rights to their design as well as the only provision of OEM parts and service expertise. Palfinger Marine has four distribution centers located throughout the domestic United States. The OEM distributors and service centers are the only OEM approved sources for replacement parts and certification of the Palfinger Marine fast rescue boat davit. Certification is completed annually or anytime major system repairs are completed and are required annually for PISCES ABS Certification. Due to the life safety and emergency requirements of the davit and to maintain PISCES ABS Class Certification, it is imperative that the fast rescue boat davit be repaired in accordance with the OEM requirements. This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can provide equipment that fully meets the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the Government.
