The US Securities and Exchange Commission (SEC) intends to award a sole source contract to Inovitech, LLC in accordance with the authority to permit other than full and open competition provided at FAR 6.302-1(a). The contract to be awarded is for Inovitech, LLC to provide the Securities and Exchange Commission (SEC) with specialized enhancements and Tier 3 Operations and Maintenance (O&M) support in support of the SEC’s Division of Enforcement (ENF) use of ENF’s Evidence Tracking System (ETS) chain of custody tool. The SEC requires enhancements and Tier 3 O&M support for use and development of the ETS tool and Inovitech, LLC is the sole proprietor of the ETS/IS-A-TASK™ tool and sole provider capable of providing the required support on their proprietary software application. ETS is a web-based commercially customizable COTS product which has been used by the SEC since 2015.  This contract action is vital to the SEC in order to allow it to receive and track SEC investigative and
litigation data. Through market research, the SEC has found that Inovitech LLC is the only source that can reasonably meet SEC's immediate requirement in accordance with FAR Part 13.501(a). Inovitech LLC is the only responsible source able to provide specialized enhancements and Tier 3 O&M support for the ETS tool.The contract action is for services for which the SEC intends to solicit and negotiate with only a sole source under the authority of FAR 6.302-1 and 41 U.S.C. 253(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Negotiation will be conducted using other than full and open competition procedures pursuant to authority of FAR 6.302-1.This notice of intent is not a request for competitive proposals. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested persons may identify their interest and capability to respond to the contract requirement or desire to submit proposals for the contract only. Sufficient information should be included to demonstrate sufficient detailed knowledge of the Evidence Tracking System. All responses received no later than the closing date of this announcement will be considered by the Government. The Government will notify parties of the outcome of any proposal submitted in response. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.Any responses to this notice of contract action shall be submitted electronically to Tucker Smith (smithtu@sec.gov) and John Bova (bovaj@sec.gov) no later than 12:00 PM, EST, September 23, 2021.
