Notice of Intent To Award Sole Source Contract; ECTOCRYP Black Encryption Device

PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The Federal Bureau of Investigation (FBI) intends to award a sole-source, one-time, firm-fixed price contract to AIRBUS U.S. Space and Defense, Inc., Arlington, Virginia, 22209, (CAGE Code 8W891), for two (2) ECTOCRYP Black encryption devices. This acquisition includes the following: Two (2) ECTOCRYP Black units with a one (1) Year Warranty; and Two (2) 3-Year Extended Warranties. ECTOCRYP Black is a high-capacity programmable, secure, voice encryption device that can protect voice communications up to and including Top Secret; with a National Security Agency (NSA) approved Authority to Operate (ATO). The ECTOCRYP Black unit can conduct secure voice communications efficiently, economically, and effectively between two established and separate security domains.ECTOCRYP Black is the only device of

its kind on DISA's DoD Info Network (DoDIN) Approved Products List (APL) which is mandated by the publicly available Department of Defense Instruction (DoDI) 8100.04, Unified Capabilities (UC). The UC APL is the single authoritative source for certified UC products intended for use on DoD networks.ECTOCRYP Black is solely manufactured and repaired by AIRBUS U.S. Space and Defense, Inc. There are no authorized third-party resellers/facilities. ECTOCRYP Black manuals and equipment are proprietary to AIRBUS U.S. Space and Defense, Inc. There are no authorized third-party vendors for training or operational support.AIRBUS U.S. Space and Defense, Inc. is the only source for warranty coverage.The North American Classification System Code (NAICS) is 334515, Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals. The statutory authority permitting other than full and open competition is Title 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”This notice will be distributed solely through the General Services Administration's Federal Business Opportunities (FBO) Website, (www.beta.sam.gov). Interested parties are responsible for monitoring the FBO site to ensure they have the most up-to-date information about this acquisition. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency no later than 9:00 AM (EST) on 7 APRIL 2023. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Telephone requests will not be considered. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. No reimbursement for any cost connected with providing capability information will be provided. The information provided herein is subject to change and in no way binds the Government to solicit for or award a contract. Vendors must be registered in SAM, (effective July 29, 2012), to receive government contracts. The FBI utilizes a financial system that has a direct interface with SAM. Please ensure that your company’s SAM information is updated and accurate. This includes the TIN, EFT, DUNs, UEI, addresses, and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment to your organization.Justification for Other Than Full and Open Competition is available upon request.
