LEGAL NOTICE In the matter of the vacation of an alley adjoining Lots #1, #2, #3, #4 and #5 in the Plat of the town of Landeck, Marion Township, Allen County, Ohio. Notice is hereby given by the Board of County Commissioners of Allen County, Ohio that a petition was filed in this office by Anna Mae Blankemeyer, Attorney for the Catholic Diocese of Toledo as follows: Alley Vacation 0.229 Acres Situated as being part of a 16.5-foot alley adjoining lots 1, 2, 3, 4 and 5 in the Plat of the town of Landeck in the Southeast Quarter of Section 3, Township 3 South, Range 4 East, Marion Township, Allen County, Ohio, as recorded in Plat Book 2, Page 58-59 and more particularly described as follows: Commencing at a Monument box found marking the Southwest corner of the Southeast Quarter of Section 3; Thence North 00°30’ 15” East along the East line of said Southeast Quarter (State Route 65) a distance of 566.21 feet to a point; Thence North 00°20’ 55” East along the West line of said Southeast
Quarter (Kill Road) a distance of 231.00 feet to a point marking the Southwest corner of a 2.61 acre tract of land as recorded in Deed Volume 923, Page 904, referenced by a mag nail found lying 0.18 feet South and 0.17 feet West of said point; Thence South 89°20’ 16” East along said the South line of said 2.61 acre tract a distance of 20.00 feet to a 5/8 inch rebar with ID cap set on the East line of Kill Road marking the Northwest corner of said 16.5-foot alley and the POIT OF BEGINNING: Thence continuing South 89°20’ 16” East along said South line and the North line of said 16.5 foot alley a distance of 420.00 feet to a 5/8 inch rebar found marking the Southeast corner of said 2.61 area tract; Thence South 00°20’ 55” West along a new division a distance of 16.50 feet to a 5/8 inch rebar with ID cap set on the North line of Lot 5 as recorded in Plat Book 2, Page 58 and Deed Volume 892, Page 717, passing a 5/8 inch rebar with ID cap set at 8.25 feet on the centerline of said alley; Thence North 89°20’ 16” West along the North line of said Lot 5 a distance of 5.00 feet to a 5/8 inch rebar with ID cap set marking the Northwest corner of said Lot 5; Thence South 00°20’ 55” West along the West line of said Lot 5 a distance of 184.50 feet to a 5/8 inch rebar with ID cap set on the North line of Landeck Road marking the Southwest corner of said Lot 5; Thence North 89°20’ 16” West along said North line a distance of 16.50 feet to a 5/8 inch rebar with ID cap set marking the Southeast corner of Lot 4 as recorded in Plat Book 2, Page 58 and Official Record Volume 2019, Page 6316, passing a drill hole set at 8.25 feet marking the centerline of said alley; Thence North 00°20’ 55” East along the East line of said Lot 4 a distance of 184.50 feet to a 5/8 inch rebar with ID cap set marking the Northeast corner of said Lot 4; Thence North 89°20’ 16” West along the North line of said Lot 4 and the North line of Lot 3, Lot 2 and Lot 1 as recorded in Plat Book 2, Page 58 a distance of 398.50 feet to a 5/8 inch rebar with ID cap set on the East line of Kill Road marking the Northwest corner of said Lot 1; Thence North 00°20’ 55” East along said East line a distance of 16.50 feet to the POINT OF BEGINNING, passing a mag nail set at 8.25 feet marking the centerline of said alley, said alley vacation containing 0.229 acres of land, more or less. Subject to all legal highways, easements, and restrictions of use whether apparent and/or of record and is from an actual field survey performed in August, 2023, under the supervision of Ohio Professional Surveyor Seth D. Schroeder, Ohio Surveyor No. 8784. Note: The bearings used in this description are on an assumed meridian assuming the South line of the Southeast Quarter of Section 3 (Landeck Road) to be North 89°20’ 16” West and are for the purpose of angle determination only. We hereby fix the 9th day of May, 2024 at 1:30 p.m. at the Allen County Commissioner’s Office, 204 N.
