This notice is being published in accordance with Federal Acquisition Regulation (FAR) 8.405-6(a)(2) requiring dissemination of information for proposed contract action. This is a notice of intent to award a sole source modification and is not a request for competitive quotes or proposals.The Government hereby submits a notice of intent to award a sole source modification for non-personal contractor support services in support of the National Guard Bureau Office of the General Counsel (NGB-GC), Office of Complex Investigations and Law Office Management Division, to Kenny Business Solutions, Inc 7217 Lockport Pl Ste 204, Lorton, VA 22079.The fundamental concept of this contract is to provide non-inherently governmental, non-personal contractor support services to the National Guard Bureau Office of the General Counsel (NGB-GC), Office of Complex Investigations (OCI) and Law Office Management Division (LOMD). The NGB-GC provides legal services, counsel, and opinions concerning
operational law, environmental law, contracts, administrative law, military justice, and other areas of law to the Chief, National Guard Bureau, the Vice Chief, National Guard Bureau, the Special Assistant to the Chief, NGB, the Directors of the Army and the Air Force and their respective staffs, State Adjutants General, full-time Judge Advocates and United States Property and Fiscal Officers (USPFO) across the 54 states and territories. The OCI provides a centrally managed cadre of investigators specially trained to investigate sexual assault reports.  At TAG’s request, OCI provides a fully-funded investigative capability to TAG.  The LELD provides primary litigation support and policy and procedure advise: (1) Federal Court and State Court cases; (2) Administrative Law; (3) Equal Employment Opportunity Commission (EEOC); (4) The Merit System’s Protection Board (MSPB); (5) The Federal Labor Relations Board (FLRB), the Office of Special Counsel (OSC), and the Military Boards of Correction. Due to a high volume of actions relating to the residual effects of the COVID-19 pandemic and other high visibility world events, the need for additional administrative support is needed in each of the aforementioned offices, to include but limited to contractor-provided logistical and technical support to each office in completing their respective missions.Responses to this notice shall demonstrate clear and convincing evidence that competition would be advantageous to the Government,  would not be cost or time prohibitive and would not hinder the mission objective to provide support services. Further, responses shall provide proof of similar services currently being provided.The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
