INVITATION TO BIDDERS As set forth in the advertisement for bids, sealed proposals will be received on the Pennsylvania Electronic Document and Bid Management Website known as PennBid at http://www.pennbid.net by the City of Lancaster, Pennsylvania (City), 120 North Duke Street, Lancaster City, Lancaster County, Pennsylvania until November 1, 2022 at 11:00 a.m., at which time bids will be electronically and posted on the website for the Long’s Park Water Quality Improvement Project. The work is generally described the installation of a natural treatment system (NTS) to capture and treat stormwater from portions of State Route (SR) 30, Long’s Pond, and Long’s Park. Some of the improvements include, but are not limited to, a pump station to convey water from Long’s Pond to a constructed NTS consisting of a treatment train that includes a Forebay equipped with floating wetlands, an Iron-Enhanced Sand Filter, and two
constructed Marshes, with discharge to Long’s Pond, affiliated vegetated and non-vegetated conveyance, pavement restoration, construction of pedestrian walkways, pedestrian bridge, and a boardwalk with a viewing platform, grading, and vegetative restoration. A Project map and general location is set forth in the introduction and project description. The terms of the introduction and project description are incorporated herein. All bids shall be effective for sixty (60) calendar days from the date of the bid opening unless an award of the Contract is delayed by the required approval of another governmental agency, the sale of bonds or the award of a grant, in which case all bids will remain effective for one hundred twenty (120) calendar days from the date of the bid opening. The successful bidder will be required to provide performance and payment bonds equal to one hundred (100%) percent of the Contract price with suitable, reasonable requirements guaranteeing the performance of the Contract. This Project and Contract are subject to certain special requirements. For example, as more specifically detailed in the Contract Documents, the successful bidder shall be required to assure protection against discrimination for employees, applicants for employment, and subcontractors on the grounds of actual or perceived race, color, sex, religion, ancestry, genetic information, national origin, sexual orientation, gender identity or expression, familial status, marital status, age, mental or physical disability, use of guide or support animals and/or mechanical aids. The Project is being funded, in part, by grant and/or loan funds. The attention of all bidders is called to the fact that the construction contracts may be subject to requirements established by the Commonwealth of Pennsylvania Department of Environmental Protection (DEP) and the Pennsylvania Fish and Boat Commission. The successful contractor, and all of his/her/its subcontractors will be required to pay laborers and mechanics employed on this Project not less than the minimum wages and fringe benefits stipulated in the Contract Documents and as required by the applicable laws referenced in this paragraph. The Contract Documents for the Project can be obtained over the internet from the Pennsylvania Electronic Document and Bid Management Program known as PennBid at http://www.pennbid.net. Potential bidders must register with PennBid online to have access to said documents. Registration is at no cost and the process takes only a few minutes. Once registered, potential bidders can obtain all project documents for the Project and for any other PennBid-registered project (for free) and thereafter submit and update his/her/its confidential proposals online prior to the deadline for submitting a bid. All proposals shall be submitted exclusively in electronic format to City through PennBid at http://www.pennbid.net. Proposals provided by any other means will not be accepted. Incomplete proposals and those received after the specified date and time will not be considered. Hand delivered, mailed, courier, faxed and/or e-mailed responses will not be accepted. Bids, after having been submitted, may be withdrawn by the bidder prior to the time set for the opening of bids upon the written direction to City through PennBid at http://www.pennbid.net. No withdrawal bids will be allowed within sixty (60) calendar days after said time, even though bids may not as yet been opened. The City will determine who is the lowest responsible bidder upon the basis of the bids submitted. The lowest responsible bidder need not be the bidder submitting the lowest dollar amount. The City may consider the quality of services supplied, responsiveness of the bidder, past performance of the bidder, compatibility of the bidder’s processes with other City services, and the bidder’s ability to handle the volume of work proposed. The City reserves the right to reject any or all bids and re-advertise if the best interest of the City will thereby be promoted. The City also reserves the right to waive technical defects if, in its judgment, the interest of the City shall so require. The City further reserves the right to waive any informalities in the bids received and reject any or all bids for any reason whatsoever. Included in its right to reject bids, is the right for the City, in its sole discretion, to reject proposals which are deemed by the City to be incomplete, conditional, or obscure, or which contain additions, erasures, alterations, omissions or irregularities of any kind. In reviewing the bids, the City will review the bidder’s experience, necessary facilities, and financial resources to furnish the items of this Contract, and the City reserves the right to reject the proposal of any bidder not possessing satisfactory qualifications.
