This acquisition is for Software Licenses for workflow designing water and wastewater systems. The proposed contract action is for services for which IHS intends to solicit and negotiate with only one source under the authority of 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-5(b)(4). The basis of the sole source is that Bentley Systems, Inc. is the only vendor capable of maintaining the existing data and software that will meet Government requirements and ensure continued IHS regulatory compliance. This notice of intent is not a solicitation, requirement for proposal or a request for quote. The determination not to compete this proposed contract action is solely within the discretion of the Government.
