Outside Legal Counsel for Disparity Study Analysis and Small Business Economic Development Advocacy The 2023 M/WBE Disparity and Causation Study is expected to be released February 2023. The selected firm shall provide the City of San Antonio with comprehensive counsel in determining if there is a need and basis, predicated on the findings of the Study, for the continuation of the City’s SBEDA Program, and shall provide legally-sound and narrowly-tailored recommendations for modifications to the Program. Counsel will advise on current legal requirements set by case law for procurement programs affecting M/WBEs and provide legal representation and consultative expertise to City in its decisions related to the Program. Counsel will provide policy options for adding or enhancing existing tools, including race-neutral program options, in alignment with the Study findings, best practices and public feedback. The selected firm shall: (1) support the City in advance of meetings of the City Council and those scheduled by City Staff (i.e. SBEDA Committee) to the extent required or requested to discuss Study findings and possible amendments to the Program; (2) attend certain public meetings involving amendments to the Program; and (3) provide ongoing legal counsel on questions that arise following the release of the Study, through program amendment adoption by the City Council, and for an initial period of amendment implementation.An original and five (5) signed copies of respondent’s proposal must be submitted to the Office of the City Clerk, P.O.
