UAPB reserve the right to award this\nbid \u201cALLOR NONE\u201d.\n\nISSUING AGENCY\nUAPB, as the issuing office, is the sole point of contact throughout this solicitation process.\n\nBID OPENING DATE AND LOCATION\n\nBids will opened at the following location:\nUAPB PROCUREMENT OFFICE\n1200 N. University Drive\nAdmin. Bldg., Room 102\nPine Bluff, Arkansas 71601\n\nTo be considered, sealed, signed, written bids must be received by the UAPB Procurement no later than the time\nand date as listed on the cover page of this IFB.\n\nAll bids and proposals shall be for public opening. Bids shall not be subject to public review until after the\ncommittee has completed its work and the award. The opening will serve only to open, read, and tabulate the\nbid price of each. No discussion will be entered into with any vendor as to the quality or provisions of the\nspecifications and no award will be made either stated or implied at the bid opening.\n\nNO BID may be withdrawn after the schedule closing time for receipt for at least sixty (60) calendar days. A Prospective Contractor\u2019s bid will be rejected if a Prospective Contractor takes exceptions to any\nRequirements in the Requirements Section(s) of this IFB.\n\nPage 2 of 24\n" "Bid Solicitation Document\n\n1.7 DEFINITION OF TERMS\n\nA.\n\nThe UAPB Procurement Official has made every effort to use industry-accepted terminology in this Bid\nSolicitation and will attempt to further clarify any point of an item in question as indicated in\nClarification of Bid Solicitation.\n\nUnless otherwise defined herein, all terms defined in Arkansas Procurement Law and used herein have\nthe same definitions herein as specified therein.\n\n\u201cProspective Contractor\u201d means a person who submits a bid in response to this solicitation.\n\u201cContractor\u201d means a person who sells or contracts to sell commodities and/or services.\n\nThe terms \u201cInvitation for Bid\u201d, \u201cIFB,\u201d \u201cBid Solicitation,\u201d and \u201cSolicitation\u201d are used synonymously in this\ndocument.\n\n\u201cResponsive bid\u201d means a bid submitted in response to this solicitation that conforms in all material\nrespects to this IFB.\n\n\u201cBid Submission Requirement\u201d means a task a Prospective Contractor must complete when submitting a\nbid response. These requirements will be distinguished by using the term \u201cshall\u201d or \u201cmust\u201d inthe\nrequirement.\n\n\u201cRequirement\u201d means a specification that a Contractor\u2019s product and/or service must perform during\nthe term ofthe contract. When the term \u201cUAPB\u201d is used herein to\nreference any obligation of the university under a contract that results from this solicitation, that\nobligation is limited to UAPB agency using such a contract.\n\n\u201cUniversity\u201d or \u201cOwner\u201d Shall be interpreted to mean University of Arkansas Board of Trustees acting\nfor and on behalf of the University of Arkansas at Pine Bluff.\n\n1.8 RESPONSE DOCUMENTS\n\nA.\n\n1.\n\nBid Response Packet\n\nThe following are Bid Submission Requirements and must be submitted in the original Bid Response\nPacket.\n\na. An.official authorized to bind the Prospective Contractor(s) to a resultant contract must sign the\nBid Signature Page included in the Bid Response Packet.\n\nii. Prospective Contractors entering into a contract with UAPB shall comply with all the terms and conditions\ncontained herein.\n\n1.10 SUBCONTRACTORS\n1. All\nProspective Contractors shall understand that this paragraph may be used as a basis for litigation.\n\nRESERVATION\n\nThis invitation does not commit UAPB to pay any cost incurred in the preparation of bids. Further, UAPB\nreserves the right to accept or reject any or all bids or any part of a bid in the best interest of the agency. We\nfurther reserve the right to award this bid \u201cAll or None\u201d whichever is in the best interest of the University to do\nso.
