BOROUGH OF SOUTH COATESVILLE Request for Proposals – Development of Solar Energy Facility SOUTH COATESVILLE BOROUGH, Chester County, seeks an entity to develop and operate a solar energy facility for the below-referenced Borough-owned properties. It is the intent of this RFP to have the successful entity enter into a Lease with the Borough pursuant to the scope outlined herein (and as otherwise determined by Borough Council in agreement with such entity). Nothing herein shall be construed as a competitive bidding process under Pennsylvania law. The proposal herein constitutes a lease not subject to bidding requirements under the Pennsylvania Borough Code. The Borough reserves the right to reject all proposals. The Borough-owned property subject to the Request for Proposals encompasses t he lease of portions of 2230-2240 Upper Gap Road, South Coatesville, PA (UPI Nos. 9-11-14 and 9-13-1) (hereinafter “the Property”).Scope of Services · Design, engineer, develop, construct, operate,
manage and maintain a solar energy facility on the Property in compliance with all applicable, Federal, State and Local laws and regulations to provide solar power generation.· Remove the solar energy facility and restore the Property at the end of the lease term. · Handle all other customary activities and services associated with operating the solar facilities. Request for Proposals To be considered, interested individuals shall submit eight (8) copies of their proposal to the South Coatesville Borough Manager, on or before 7 p.m. on May 22, 2023, at 136 Modena Road, Coatesville, PA 19320. The proposals shall be submitted in a sealed envelope, clearly marked on the outside “South Coatesville Borough Proposal – Solar Energy Facility”. Make sure you include the RFP Worksheet with your submission. We will host a question-and-answer workshop on Wednesday, April 19 at 4:00 p.m. via Zoom. The Bid Unsealing will occur at the Borough Council Meeting on Tuesday, May 23, 2023.The successful, selected proposer shall enter into a written agreement for the herein-referenced services, subject to the approval of the Borough. Proposers must also execute and submit a Non-Collusion Affidavit, in form and substance acceptable to the Borough, to be submitted with their proposal. Candidates must disclose any known or proposed business relationships between it and any employee, consultant or official of the Borough, members of their immediate family or businesses with which they are affiliated (i.e., any contract, relationship or arrangement by which the employee, official, consultant or member of their immediate family or business with which they are affiliated does or would accrue a financial or pecuniary benefit). Qualifications and ConditionsProposers must submit copies of their certificates of insurance for professional liability. Proposers must have experience in the design, engineering, development, construction, operation, management, and maintenance of a solar energy facility on other state-, county-, township- or borough-owned properties is preferred. Proposers may be requested to give an oral presentation of their background and services to the Borough Council in an executive session and/or at a public Borough meeting. Proposers must have an excellent reputation. The term of the Professional Services Contract shall be a minimum of fifteen (15) years. Issuance of this Request for Proposals or selection by the Borough Council of an entity for consideration does not constitute a contract between the Borough and any entity. A contract shall only be formed upon approval and written execution of the above-referenced lease, as approved by the Borough Council at a duly authorized public meeting. Proposers are strongly recommended to inspect the Property to discuss the parameters of the representation with the Borough Manager prior to submitting their proposal. The selected candidate must make themselves familiar, and comply with, all applicable provisions of the Pennsylvania Borough Code (including the competitive bidding requirements thereunder), the South Coatesville Borough Code, the Borough’s Zoning Ordinance, the State Ethics Act and other applicable law, related to the design, engineering, development, construction, operation, management and maintenance of a solar energy facility on the above-referenced Property. The selected candidate shall be required to provide the Borough with a quarterly report to detail the operation of the solar energy facility. The successful candidate will abide by Bi-Annual inspections by our Engineers and will comply to requests for information within 72 hours. The solar farm infrastructure and equipment will be maintained and replaced according to industry best practices and in compliance with all applicable, Federal, State, and Local laws and regulations for providing and managing solar power generation. The solar facility must incorporate natural, low visibility barriers to ensure that the facility cannot be seen by homeowners (as much as is feasible). These barriers must be approved by the Borough Council. The Borough shall have the option to take over the Solar Farm at the end of the lease period.
