NOTICE TO BIDDERS 1.1 PLACE OF SUBMISSION The City of Colleyville will accept bids submitted electronically through the following website: http://www.civcastusa.com. City Staff will begin reading the bids on Tuesday, December 6, 2022 at 2:00 p.m. • Dial-in Number: 1-972-497-2499 • Conference Code: 558104 Bids submitted electronically via http://www.civcastusa.com will be received until 2:00 p.m. on Tuesday, December 6, 2022 for the furnishing of all labor, materials, and equipment and the performing of all work required in the construction of the following project: Bid # ENG-2022-007 FY 2023 MISCELLANEOUS CONCRETE REPAIR PROJECT 1.2 INSPECTION OF BID DOCUMENTS Plans, Specifications, and Contract Documents may be examined without charge at the City of Colleyville Public Work’s Office, 100 Main Street, Colleyville, Texas 76034. Copies of such
instruments may be obtained from the following website: http://www.civcastusa.com. This website will be updated with addenda, plan holder lists, bid tabulations, additional reports or other information relevant to bidding the Project. Official plan holders list will only be the list maintained by The City. It is the sole responsibility of all plan holders, whether they have received digital downloads or paper copies of the plans and specifications, to periodically check for Addenda which may have been posted on the Civcast USA website. 1.3 PRE-BID CONFERENCE There will be a non-mandatory pre-bid conference on November 15, 2022 at 10:00 AM held via tele-conference. • Dial-in Number: 1-972-497-2499 • Conference Code: 558104 1.4 INQUIRIES Bidders should submit all inquiries and/or questions concerning this project to the person identified on the cover sheet of the Bid. 1.5 BID BOND Bidders must submit, with their bids, a cashier's or certified check in the amount of five percent (5%) of the $600,000 budgeted amount, payable without recourse to CITY OF COLLEYVILLE, TEXAS, or a Bid Bond in the same amount from a City approved Surety Company (according to the latest list of companies holding certificates of approval by the State Board of Insurance under 7.19-1 of the Texas Insurance Code) as guarantee that the Bidder will enter into a contract and execute bond and guarantee forms provided within (10) days after award of contract to their company. Bids without the required check or bid bond will be considered non- responsive. 1.6 ADDITIONAL BONDS The successful Bidder must furnish Performance, Payment, and Maintenance Bonds each in the amount of one hundred percent (100%) of the $600,000 contract price from an approved Surety Company. (An approved Surety Company being a company holding a permit from the http://www.civcastusa.com/ http://www.civcastusa.com/ State of Texas, to act as Surety, and being acceptable according to the latest list of companies holding certificates of approval from the State Board of Insurance under 7.19-1 of the Texas Insurance Code.) The successful Bidder must also be able to show evidence that it is authorized to do business in the State of Texas prior to executing the contract. 1.7 DEFINITIONS The following definitions shall apply where the corresponding terms are used herein: Bid: This Invitation for Bid # ENG-2022-007 (including all enclosed plans and specifications) Bid Response/Proposal: The response submitted by the Bidder Bidder: The person and/or entity submitting a response City: The City of Colleyville, Texas Submittals: Refers to those documents required to be submitted to the City by the Bidder 1.8 PROJECT CONDITIONS Bidders are expected to inspect the site(s) of the work and to inform themselves regarding local conditions under which the work is to be performed. 1.9 PREVAILING WAGE RATES Attention is called to the provisions of the Act of the 43rd Legislature of the State of Texas and subsequent amendments concerning the wage scale and payment of prevailing wages specified. All Bidders must comply with the rules and regulations for the Americans with Disabilities Act of 1990, as amended. 1.10 CONFLICTS OF INTEREST Chapter 176 of the Texas Local Government Code requires that any Bidder or person considering doing business with a Local Government entity, disclose in the questionnaire form CIQ, the Bidder or person’s affiliation or business relationship that might cause a Conflict of Interest. The CIQ shall be submitted with the Bidder’s completed Bid Packet. Failure to submit any form under this Section shall result in the Bid being considered non-responsive. The Bidder shall further certify (a) that its bid submittal is genuine and is not made in the interest of, or on behalf of, any undisclosed person, firm, or corporation; (b) that he/she has not directly or indirectly induced or solicited any other respondent to put in a false or sham bid; (c) that he/she has not solicited or induced any other person, firm, or corporation from proposing; and (d) that he/she has not sought by collusion to obtain for him/herself any advantage over any other respondents or over the City. 1.11 ADDENDA Any addenda issued during the time allowed for the preparation of bids shall be covered in the bid and, in executing the contract, they shall become a part thereof. Failure of a Bidder to receive any addendum shall not release the Bidder from any obligations under the bid that appear in said addenda, provided said addendum was sent by either U. S. Mail to the address furnished by the Bidder for transmittal of U. S. Mail, by telephone facsimile transmission, or by email. 1.12 BIDDING ALTERNATES Alternatives to manufacturer-specified equipment or materials must be pre-approved in writing prior to bid opening. 1.13 ACCEPTANCE Any offer received shall be considered an offer, which may be accepted by the City based on initial submission without discussions or negotiations. By submitting an offer in response to this solicitation the Bidder agrees that any offer it submits may be accepted by the City at any time within 90 days from the close date. The City reserves the right to reject any or all offers and to waive informalities and minor irregularities in offers received, and/or to accept any portion of the offer if deemed in the best interest of the City. Failure of the bidder/proposer to provide in its offer any information requested in the bid may result in rejection for non- responsiveness. 1.14 METHOD OF SELECTION The City intends to make an award using the evaluation criteria and other factors as indicated in this bid/proposal. The award shall be awarded on the bases of “best value”, based on the lowest responsible bidder and best-qualified bidder whose evaluation by the City indicates to be in the best interest of the City and taxpayers. The award to the successful bidder will be determined by best value to the City as allowed by Chapter 252 of the Local Government Code. The following criteria will be considered when selecting the successful Bidder: • the purchase price; • the reputation of the bidder and the bidder's services; • the quality of the bidder's service; • the extent to which the bidder's services meet the City's needs; • the bidder's past business relationship with the City; • the impact on the ability of the City to comply with laws and rules relating to contracting with historically underutilized businesses and non-profit organizations employing persons with disabilities; and • the total long-term cost to the City to acquire the bidder’s goods or services. In evaluating criteria, contractor shall provide references for the same or similar work from five (5) Cities of similar or greater size than Colleyville. 1.15 BIDDER STANDARDS The minimum standards for responsible prospective bidders are as follows: • Have adequate financial resources, or the ability to obtain such resources • Be able to comply with the required or proposed schedules and project requirements • Competitive pricing • Have a satisfactory record of performance for contracts of similar scope • Have a satisfactory record of integrity and ethics • Completeness and thoroughness of bid submittal The City may make such investigations as it deems necessary to determine the ability of the bidder to provide satisfactory performance in accordance with bid requirements, and the respondent shall furnish to the City all such information and data for this purpose. 1.16 BIDDER SUBMITTALS Bid Responses shall be submitted on the forms provided to insure complete uniformity of wording of all bids. All lump sum and unit prices must be stated in both script and figures. Bids may be rejected if they show any omissions, alterations in wording, conditional clauses, or irregularities of any kind. If an emergency or unanticipated event interrupts normal City processes so as to cause postponement of the scheduled bid opening, the time specified for receipt of bids will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal City processes resume or to such other date and time as may be provided by the City in a written notice to Bidders.
