STATE OF NORTH CAROLINA STANDARD FORM OF INFORMAL CONTRACT AND GENERAL CONDITIONS FOR Buncombe County Schools Request for Proposal Technology Department – System Wide One-to-One Student Device Refresh RFP 07-23 Bid Issue Date: Tuesday, February 28, 2023 Bid Due Date: Wednesday, March 15, 2023 SCOPE OF WORK Work shall consist of furnishing a quote for one-to-one student devices as outlined by the following proposal. Buncombe County Schools reserves the right to reject any and all bids for any or no reason, and to waive informalities. PROPOSAL Proposals subject to the conditions made a part hereof will be received until Wednesday, March 15, 2023, at 2:00 p.m. EST for furnishing all equipment and services incidental and implied for completion of the system wide one-to-one student device refresh project. NOTICE TO BIDDERS Bids for this RFP must be received by one of the following options: Mail or Deliver to: Buncombe County Board of Education Attention: Purchasing Department 175 Bingham Road Asheville NC 28806 Please note on the envelope: Bid: RFP 07-23 One-to-One Student Device Refresh Bid Closing Date: Wednesday, March 15, 2023 Delivered bids will be accepted at the Buncombe County Board of Education using the Visitor Entrance (Entrance A) only. Bids may be delivered Monday – Friday from 8:00 a.m. to 4:00 p.m. Bid proposals will not be accepted after 2:00 p.m. EST on the bid closing date. Request for Proposal (RFP) is issued to prospective offeror/vendors. 2. All proposals and device samples must be received by Buncombe County Schools no later than the date and time specified on the RFP cover sheet. One original proposal must be delivered in a sealed envelope. The original proposal form must be signed and dated by an official authorized to bind the firm. Unsigned proposals will not be considered. 3. On Wednesday, March 15, 2023, at 2:00 p.m. EST proposals will be opened and a bid tabulation will be completed. Interested parties are cautioned that these costs and their components are subject to further evaluation for completeness and correctness. Therefore, the recorded bid may not be an exact indicator of an offeror’s pricing position. Proposals are confidential until such time award has been made. At that time, the Purchasing Department will make the bid tabulation public by posting it to the Buncombe County School Purchasing Bids and Proposal website. 4. Proposals will be evaluated according to completeness, content, experience with similar projects, ability of the offeror and their staff, and cost. Award of a contract to one offeror does not mean that the other proposals lacked merit, but that, all factors considered, the selected proposal was deemed most advantageous to Buncombe County Schools. 5. Offerors/vendors are cautioned that this is a request for offers, not a request to contract. Buncombe County Schools reserves the unqualified right to reject any and all offers when such rejection is deemed to be in its best interest. Buncombe County Schools Form of Proposal Technology Department System Wide – One-to-One Student Device Refresh RFP 07-23 Due Date: Wednesday, March 15, 2023 The undersigned, as bidder, hereby declares that the only person or persons interested in this proposal as principal or principals is or are named herein and that no other person than herein mentioned has any interest in this proposal or in the contract to be entered into; that this proposal is made without connection with any other person, company or parties making a bid or proposal; and that it is in all respects fair and in good faith without collusion or fraud. The bidder also certifies that none of their officers, directors, or owners of an unincorporated business entity has been convicted of any violations of Chapter 78A of the General Statutes, the Securities Act of 1933, or the Securities Exchange Act of 1934 (G.S. 143-59.2), and that they are not an ineligible vendor as set forth in G.S. 143-59.1. False certification is a Class I felony. The bidder further declares that he has examined the bid documents relative thereto and has read all special provisions furnished prior to the opening of bids; that he has satisfied himself relative to the work to be performed. Buncombe County Schools began a phased personalized K-12 1:1 digital learning initiative in 2015/2016 and intends to continue the next refresh phase with district-owned Windows TM touchscreen devices in July 2023. EXCEPTIONS: All proposals are subject to the terms and conditions outlined herein. All responses shall be controlled by such terms and conditions and the submission of other terms and conditions, price lists, catalogs, and/or other documents as part of an offeror's response will be waived and have no effect either on this Request for Proposals or on any contract that may be awarded resulting from this solicitation. Offeror specifically agrees to the conditions set forth in the above paragraph by signature to the proposal. 2. CERTIFICATION: By executing the proposal, the signer certifies that this proposal is submitted competitively and without collusion (G.S. 143-54), that none of our officers, directors, or owners of an unincorporated business entity has been convicted of any violations of Chapter 78A of the General Statutes, the Securities Act of 1933, or the Securities Exchange Act of 1934 (G.S. 143-59.2), and that we are not an ineligible vendor as set forth in G.S. 143- 59.1. ELABORATE PROPOSALS: Elaborate proposals in the form of brochures or other presentations beyond that necessary to present a complete and effective proposal are not desired. In an effort to support the sustainability efforts of the State of North Carolina we solicit your cooperation in this effort. It is desirable that all responses meet the following requirements: ● All copies are printed double sided. ● All submittals and copies are printed on recycled paper with a minimum post-consumer content of 30% and indicate this information accordingly on the response. ● Unless absolutely necessary, all proposals and copies should minimize or eliminate use of non-recyclable or non-re- usable materials such as plastic report covers, plastic dividers, vinyl sleeves, and GBC binding. Three-ringed binders, glued materials, paper clips, and staples are acceptable. ● Materials should be submitted in a format which allows for easy removal and recycling of paper materials. 6. COST FOR PROPOSAL PREPARATION: Any costs incurred by offerors in preparing or submitting offers are the offerors' sole responsibility; the State of North Carolina/Buncombe County Schools will not reimburse any offeror for any costs incurred. 7. TIME FOR ACCEPTANCE: Each proposal shall state that it is a firm offer which may be accepted within a period of 45 days. Although the contract is expected to be awarded prior to that time, the 45-day period is requested to allow for unforeseen delays. 8. TITLES: Titles and headings in this RFP and any subsequent contract are for convenience only and shall have no binding force or effect. 9. CONFIDENTIALITY OF PROPOSALS: In submitting its proposal the offeror agrees not to discuss or otherwise reveal the contents of the proposal to any source outside of the using or issuing agency, government or private, until after the award of the contract. Offerors not in compliance with this provision may be disqualified, at the option of the State/Buncombe County Schools, from contract award. Only discussions authorized by the issuing agency are exempt from this provision. 10. RIGHT TO SUBMITTED MATERIAL: All responses, inquiries, or correspondence relating to or in reference to the RFP, and all other reports, charts, displays, schedules, exhibits, and other documentation submitted by the offerors shall become the property of the State/Buncombe County Schools when received. 11. OFFEROR’S REPRESENTATIVE: Each offeror shall submit with its proposal the name, address, and telephone number of the person(s) with authority to bind the firm and answer questions or provide clarification concerning the firm's proposal. 12. SUBCONTRACTING: Offerors may propose to subcontract portions of the work provided that their proposals clearly indicate what work they plan to subcontract and to whom and that all information required about the prime contractor is also included for each proposed subcontractor. 13. PROPRIETARY INFORMATION: Trade secrets or similar proprietary data which the offeror does not wish disclosed to other than personnel involved in the evaluation or contract administration will be kept confidential to the extent permitted by NCAC T01:05B.1501 and G.S. 132-1.3 if identified as follows: Each page shall be identified in boldface at the top and bottom as "CONFIDENTIAL". Any section of the proposal which is to remain confidential shall also be so marked in boldface on the title page of that section. Cost information may not be deemed confidential. In spite of what is labeled as confidential, the determination as to whether or not it is shall be determined by North Carolina law. 14. HISTORICALLY UNDERUTILIZED BUSINESSES: Pursuant to General Statute 143-48 and Executive Order #150, Buncombe County Schools invites and encourages participation in this procurement process by businesses owned by minorities, women, disabled, disabled business enterprises and non-profit work centers for the blind and severely disabled. The Contractor agrees in particular to maintain open hiring and employment practices and to receive applications for employment in compliance with all requirements of applicable federal, state and local laws and regulations issued pursuant thereto relating to nondiscriminatory hiring and employment practices. Each Prime Contractor shall undertake an affirmative action program to ensure that no person shall be excluded from participation in any employment activities because of age, sex, race, religion, color, national origin or handicap. 15. PROTEST PROCEDURES: If an offeror wants to protest a contract awarded pursuant to this solicitation, they must submit a written request to the Purchasing Officer, Buncombe County Schools, 175 Bingham Road, Asheville, NC 28806. This request must be received by the Purchasing Division within thirty (30) consecutive calendar days from the date of the contract award and must contain specific sound reasons and any supporting documentation for the protest. NOTE: Contract award notices are sent only to those actually awarded contracts, and not to every person or firm responding to this solicitation. Contract status and award notices are available through the purchasing division or the project designer with contact information as shown on the first page of this solicitation. Offerors may call to obtain a verbal status of contract award. All protests will be handled pursuant to the North Carolina Administrative Code, Title 1, Department of Administration, Chapter 5, Purchase and Contract, Section 5B.1519. 16. VENDOR REGISTRATION AND SOLICITATION NOTIFICATION SYSTEM: Vendor Link NC allows vendors to electronically register free with the State to receive electronic notification of current procurement opportunities for goods and services available on the Interactive Purchasing System. 18. RECIPROCAL PREFERENCE: G.S. 143-59 establishes a reciprocal preference law to discourage other states from applying in-state preferences against North Carolina’s resident offerors. Buncombe County Schools began a phased personalized K-12 1:1 digital learning initiative in 2015/16 and intends to continue the next refresh phase with district-owned WindowsTM touchscreen devices in July/August 2023. Buncombe County Schools is currently 1:1 K-12 with 9th Gen 10.2” iPad K-2 and Dell Latitude 3190 Education 11.6” Windows Touchscreen N5030 Processor 8G RAM 128 SSD Convertible Windows Touchscreens 3rd-12th grade. As a part of the REFRESH of 4th-6th devices in July 2023 trade in for residual value will be considered. If options to renew are exercised, trade-in for residual value will be considered for laser etched 7th-9th, 10th-12th, and 3rd grade devices. Buncombe County Schools intends to purchase a minimum of 5,000 WindowsTM touchscreen devices with keyboards (convertible 2-in-1) in the initial year based on projected 4th-6th grade enrollment using a “Best Value” approach taking into account the evaluation criteria below. The agreement resulting from this RFP will be in effect for a term of one (1) year from the date of award, with the option to renew two (2) additional one-year periods. The maximum length of the contract with all renewals is three (3) years but could stretch across four (4) fiscal years with an effective start date of July 15, 2023 and final end date of July 14, 2027. Buncombe County Schools encourages all OEMs to provide all resellers with “first preferred vendor” pricing for this project. A contract award decision is expected by the School Board no later than Thursday, June 1, 2023. Buncombe County Schools’ Digital Learning Initiative Summary ● House Bill 44: Digital content and curriculum by 2017/2018 instructed our Digital Learning Initiative now in its fourth phase. ● Our plan calls for refreshing devices after their fourth year of service. ● Fourth through sixth grade refresh devices will be distributed to students in August 2023, 7th-9th grade refresh devices in July 2024, 10th-12th grade refresh devices in July 2025, and possibly 3rd grade refresh devices in July 2027. ● Device choices (Windows 2-in-1 Convertible) reflect staff preference, experience, pilot feedback, career and college readiness, and our desire to accelerate and not limit personalized learning opportunities. ● Intel, Microsoft and others may offer additional no-cost One-to-One Professional Development over 3000 units. ● Unified student body, faculty and administration embracing student centered learning. ● Professional development has been coordinated incorporating technology across the curriculum. All instructional staff (well over 2000) have had 30 hours of 1:1 Professional Development in the past five years. ● Provides the devices and access necessary to deeply incorporate S.T.E.A.M (Science, Technology, Engineering, Arts and Math) across the curriculum across the district. Scope of Service Offeror/Vendor shall: 1. Propose only “Education” series WindowsTM Touchscreen 2-in-1 convertible devices. 2. Have supplied a purchase contract of similar size and value. 3. Have been in the business of selling computers for a minimum of five years. 4. Identify the names and contact information for any individuals assigned the responsibility of handling the account. 5. Provide four (4) references from current customers that have made large volume purchases similar in scope to this procurement. References are to be from state or local government agencies and/or organizations, which are substantially serviced by the vendor (references most similar to Buncombe County Schools are preferred). Each reference must contain the reference’s name, email address, physical address, telephone number, and point of contact. 6. Be the manufacturer or factory authorized to purchase products directly from the computer manufacturer or a reseller authorized to purchase from a distributor that is factory authorized to purchase products directly from a computer manufacturer. 7. Be the manufacturer or certified by the manufacturer of the item(s) to provide warranty repair on the equipment included in the proposal. 8. Absorb a penalty of 10% reduction in per unit cost if devices are not delivered within 90 days from date of purchase order. 9. Describe in detail any applicable self-maintainer, warranty, or accidental damage protection program that comes as standard or as options. 10. Image and Active Directory domain join all devices using Buncombe County Schools supplied Windows Enterprise Operating System image (Buncombe County Schools is a Microsoft EES “A3” Lease Agreement District) on our local network. Offeror/vendor will scan the serial number, apply the Buncombe County Schools supplied fixed asset tag, and scan the asset tag on our premises. We prefer the serial number barcode to be located on the bottom of the laptop in addition to the outside of the box. 11. Describe in detail how your business plans to ensure that remote/unattended BIOS firmware upgrades can be accomplished on the device. Note: Buncombe County Schools is a Windows 11 Enterprise/Windows Server/ SCCM Configuration Manager (Current Branch) environment. Note: We want to ensure that we can do unattended or silent BIOS firmware updates, after initial deployment, without having to physically touch the machines. We prefer the capability to remotely remove a BIOS password, change BIOS configuration settings, and then reapply the BIOS password. 12. Ship devices to our loading dock at 175 Bingham Road, Asheville, NC at no additional cost. No lift truck required. 13. Etch all devices with the BCS logo (approximately 1” x 3” but could be smaller or larger as needed to fit the space.) provided per Appendix A. Note: We can provide a 2-bit black and white high resolution image in either .BMP, .TIF or .JPG format. 14. Provide only OEM power bricks and power cords. 15. Provide for at least two evaluation units of proposed make/model to be on site by the time RFP closes. Offeror/Vendor may request evaluation unit possession acknowledgement for a unit or units the offeror/vendor is authorized to sell by emailing robert.frisby@bcsemail.org prior to closing. A minimum of two evaluation units of proposed make/model is required. 16. Confirm, in writing, that devices DO NOT contain technology from Huawei or ZTE. Device Specifications/Minimum Requirements 1. Form Factor: Windows touchscreen w/ keyboard (2-in-1 convertible with pen support), prefer MIL-SPEC tested 2. Minimum publicly advertised battery life: 10 hours 3. Wireless card: Dual Band 2 x 2 802.11ax ( Wi-fi 6 ) 4. Memory installed: 8 GB RAM (DDR4/LPDDR4 Standards including all addendums) 5. Hard Disk installed: 128 GB SSD minimum M.2 NVMe interface. NO eMMC drives or integrated motherboard hard drives solutions will be accepted due to long term parts and performance issues. 6. Processor Manufacturer: Intel or AMD 7. Processor: Celeron or better with 64-bit support for Dual Band 2 x 2 802.11ax or better, Intel or AMD Virtualization Technology, and support for remote/unattended BIOS firmware updates. 8. Must contain Trusted Platform Module v2.0 (TPM) chip technology. 9. Operating System: Windows 11 Enterprise via Microsoft EES “A3” License Agreement and provided image therefore use Ubuntu, Windows Home or Shape the Future (E9F12C232B) if available for pricing, whichever is less. 10. Graphics: Integrated Graphics that supports 4K resolution and supports dual monitors or displays 11. Accidental Damage Protection (ADP): please quote 1-4 year ADP options and with or without case. 24. Base bid unit price including imaging, etching, delivery, inventory, and 1-year manufacturer’s warranty must not exceed $450.00. Please show device warranty, battery warranty, and ADP options as increases in base bid price. 25. Provide a replacement parts list and current cost. The Shape the Future program allows qualifying K-12 institutions* to purchase Windows devices from participating technology partners, typically at a discount from their retail price. Shape the Future program prices for Windows devices are set by technology partners who have access to discounted National Academic licenses.
