Notice of Application for State Water Quality CertificationPublic Notice (PN) Date: April 8, 2024 PN Reference Number: POA-2020-00063 v1.0 PN Expiration Date: May 8, 2024 Waterway: Klawock Inlet Any applicant for a federal license or permit to conduct an activity that might result in a discharge into waters of the United States, in accordance with Section 401 of the Clean Water Act (CWA), must also apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA and the Alaska Water Quality Standards (18 AAC 70). The scope of certification is limited to the water quality-related impacts from the activity subject to the Federal license or permit (40 CFR 121.3, 18 AAC 15.180). Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received0F [1] for the discharge of dredged and/or
fill materials into waters of the United States (WOTUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.To comment on the project or request for a public hearing with respect to water quality, submit comments electronically via the DEC public notice site at https://water.alaskadec.commentinput.com?id=4TuKeCQZh on or before the public notice expiration date listed above.Applicant: Shaan-Seet Inc, Edward Douville, 501 Main Street, Craig, AK 99921, (907) 826-3251; eddouville@shaanseet.comProject Name: Shaan Seet Drive Down RampDates of the proposed activity is planned to begin and end: 08/01/2024 to 02/01/2025. Location: The proposed activity is located within Section S5, T. 74S, R. R81E, Copper River Meridian, in Prince of Wales-Hyder Census Area, Alaska. Project Site (Latitude, Longitude): 55.478260, -133.14810.Purpose: The purpose of this project is to replace the existing pier and floats that have exceeded its useful life. The project will have a ramp that is wide enough for vehicles to drive down to the new float, allowing for better commercial access for large operations, charter boats, fish processing, and other water dependent marine uses and will include the discharge of fill.Description of Proposed Work: The project would consist of removing 168 linear feet of wood pier, 800 square feet of wood float, and removing 33 existing creosote pilings. The new project would include the placement of 6,949.4 cubic yards of rock fill into 17,900 square feet below the high tide line, placement of six (6) new 18-inch diameter galvanized steel pilings, and placement of 2,400 square feet of wooden float. The project would include a 12-foot by 100-foot concrete breakwater held in place by three (3) 18-inch diameter galvanized steel pilings. A crane and spud barge measuring 140 feet by 40 feet would be used to hold an ICE 216B vibratory hammer, which has a maximum vibrations per minute (VPM) of 1750 and 50 tons of driving force. If the vibratory hammer cannot achieve embedment, an ICEI-19 impact hammer with 200 tons of driving force would be used. A boom boat or a mini tug and a work skiff would be transported on the crane and spud barge. A material barge transporting from Ketchikan to Craig may also be utilized.The facility is designed to host the local charter fishing fleet, which has vessels ranging from 28 feet to 36 feet. There are a few slips that have been designed for the smaller skiffs owned by the local residents of Craig. In total, the agent anticipates ten (10) vessels ranging in size from 26 feet to 40 feet and eight (8) vessels ranging from 16 feet to 24 feet.Applicant Proposed Mitigation: The applicant proposes the following mitigation measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material. Avoidance: This is a water dependent project with removal and replacement of an existing marine facility, so avoidance is not practical. Minimization: A minimum amount of fill will be used to limit the impact of construction on affected waters. Mitigation: The applicant states that no compensatory mitigation is proposed for this project. After reviewing the application, the Department will evaluate whether the activity will comply with applicable water quality requirements (any limitation, standard, or other requirement under sections 301, 302, 306, and 307 of the CWA, any Federal and state laws or regulations implementing those sections, and any other water quality-related requirement of state law). The Department may certify (or certify with conditions) with reasonable assurance the activity and any discharge that might result will comply with water quality requirements.
