Federal Acquisition Regulation as indicated in the attached SF18.  The SF18 form is being utilized to generate the applicable clauses from the Standard Procurement System. This requirement is not eligible for small business set-aside.The Naval Surface Warfare Center Dahlgren Division (NSWCDD) intends to award on a sole source basis to McCabe Software for the following manufactured products:  Part Number: M-IQ-SERVER, 1 Year Maintenance. McCabe Software is located in Berlin, MD.The required software is exclusive to McCabe Software. The McCabe Software is currently installed, configured, and supports the existing systems. The software was approved during the Critical Design Review for Low Rate Initial Production. If this software is not purchased, the MDT system will fail training requirements due to the lack of software simulating the voice functionality of tactical systems. Using another manufacturer’s software would cause design changes, research, development, test, and the approval process to meet Authority to Operate (ATO) standards, which could lead to over 952 direct productive person hours and additional costs to the Government.Please include shipping/freight cost to Dahlgren, VA 22448-5114. Simplified Acquisition Procedures (SAP) will be utilized for award in accordance with FAR Part 13.  The order shall be firm fixed price.  All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.  The completion and submission to the Government of an offer shall indicate the Offeror’s unconditional agreement to the terms and conditions in this solicitation.
