The California Department of Transportation (Caltrans) is seeking an experienced Consultant that has performed a minimum of three (3) to five (5) disparity studies, for public transportation agencies in the last five (5) years to identify barriers in the utilization of minority and women-owned businesses in the highway contracting industry (including trucking and supply firms). The Consultant must have the ability to perform data collection and analyses on the availability and utilization of minority and women-owned businesses, within the relevant geographic market area, from projects awarded January 1, 2015, through December 31, 2018, upon which to base a legally defensible Disadvantaged Business Enterprise (DBE) Program. (See Exhibit A for definitions of minorities, DBEs, and relevant geographic market area).

Caltrans DBE Program is administered in accordance with the requirements of 49 Code of Federal Regulations (CFR) Part 26, as amended on October 3, 2019, and including
applicable court decisions on the implementation and administration of such a program in the public highway transportation contracting industry. The Caltrans DBE Program applies only to the United States Department of Transportation (USDOT) federally funded projects.

In accordance with Federal Highway Administration (FHWA), Caltrans conducted availability and disparity studies in 2007, 2012 and 2018 to assist in determining a base figure for the relative availability of DBEs and whether it was necessary to include race-conscious measures. The final report for each Study is available through the Office of Business and Economic Opportunity (OBEO).

Directly involved with Caltrans DBE Program are select Caltrans Headquarters Divisions and Offices, including the OBEO, the Division of Engineering Services, the Division of Procurement and Contracts, the Division of Construction, the Division of Local Assistance, and the Division of Mass Transportation, as well as Caltrans¿ 12 District Offices and its approximately 600 sub-recipients (Local Agencies). The California Department of General Services may play an indirect or peripheral role as it maintains information on certified small businesses. There are no other state agencies/departments directly involved in the DBE Program as administered by Caltrans and its sub-recipients.
