714-562-3740 maverell@buenapark.com Bids to Owner's Agent Description Scope of Services Notice is hereby given that the City of Buena Park (“City”) is soliciting Statement of Qualifications (SOQ) / proposals from Energy Services Companies (“ESCOs”) to provide comprehensive design-build services for implementing certain energy conservation, energy efficiency, energy generation and related energy capital improvements, as well as water conservation measures at designated City facilities (“Project”) pursuant to California Government Code section 4217.10 et seq. (Section 4217.10”). The City does not anticipate providing any upfront capital to finance the Project but rather intends for the conservation and efficiency measures included in the Project to pay for themselves from energy and operational savings generated over the useful life of the improvements. Other Details This solicitation is being issued and any resulting contracts will be awarded pursuant to the progressive design-build process in California Public Contract Code section 22185 et seq. (also known as Senate Bill 706). Consistent with this statutory process, it is the City’s intent to enter into a contract with the successful ESCO to begin design and preconstruction activities sufficient to establish a guaranteed maximum price for the Project (“GMAX”). If the City and selected ESCO reach an agreement as to the GMAX, the City may authorize the ESCO to complete the remaining design and proceed with construction of the Project. If the City and selected ESCO do not reach an agreement on the GMAX, or if the City otherwise elects not to amend the original contract with the ECSO, the City reserves the right to either: solicit alternative proposals and contract for the remaining design and construction work with another ECSO responding to this RFQ, or alternatively to solicit competitive proposals and award the remaining work on a best value basis.
