This contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs. The Cobb County Department of Transportation overall goal for Disadvantaged Business Enterprises (DBE) participation of USDOT assisted projects of 7%. All Bidders are strongly encouraged to consider the use of DBE in all aspects of the Contract that will be awarded. Any subsequent changes and/or substitutions of DBE firms from the original DBE Participation Schedule must be submitted and approved by the County in advance. Monthly DBE reports must be submitted with each monthly invoice. DBE firms must be certified with the Georgia Department of Transportation's Equal Employment Opportunity (EEO) office. No Small Business reports are currently required; however, this is subject to change at the County’s discretion. In accordance with, 49 Code of Federal Regulations, Part 26.11 required Cobb County Department of Transportation to develop and maintain a “bid opportunity list”. The list is intended to be a listing of all firms participating or attempting to participate, on Federally Funded projects, including both DBEs and non-DBEs. The work to be performed consists of the furnishing of all materials, labor, equipment and other things necessary for the complete construction of: Project No.: X2770 Project Name: Mableton Parkway Pedestrian Improvements, Phase 2 Mableton Parkway Pedestrian Improvements, Phase 2, includes construction of a ten-foot wide multi-use trail on the west side of Mableton Parkway, from Veterans Memorial Highway to Factory Shoals Road. Sidewalks will be added to fill in the gaps within a segment of existing trail, providing a continuous connection from just north of the Chattahoochee River to the Silver Comet Trail. Traffic signal upgrades are also included at signalized intersections within the project limits. The total project length of Phase 2 is approximately 1.30 miles. Time allowed for the performance of this project is 530 calendar days. The Contract shall not expire for an additional 365 calendar days from Final Acceptance to allow for all administrative processes to be completed. Payment will be made monthly based on approved invoices. Cobb County Water System work is involved on this project. Only contractors or sub-contractors who have been prequalified with Cobb County Water System are allowed to perform water and sewer relocation work associated with this project. Bidders or their water/sewer subcontractor are required to have a State of Georgia Utility Contractor License. For all bids on contracts involving utility work as defined in O.C.G.A. 43-14-1 et.seq., the Contractor and/or its subcontractor(s) that will perform utility work must have a valid State of Georgia Utility Contractor License and comply with all applicable provisions of Chapter 14 of Title 43 of O.C.G.A. The Contractor must meet the current bid requirements of the Georgia Department of Transportation. The Cobb County, Georgia, Department of Transportation, in accordance with Title VI of the Civil Rights Act of 1964 and 78 Stat. 252, 42 U.S.C 2000d—42 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in federally assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, national origin, disability, or age in consideration for an award. Failure to comply with any of the requirements and procedures of the County (e.g., failure to timely supply required affidavits or compliance certification documents in a timely manner; failure to utilize federal work authorization procedures; failure to permit or facilitate audits or reviews of records by County officials upon request; and/or failure to continue to meet any of the statutory or County obligations during the life of the contract) shall constitute a material breach of the agreement and shall entitle the County to dismiss any general contractor or to require the dismissal of any subcontractor or sub/subcontractor (regardless of tier) for failing to fully comply with these requirements, and that upon notice of a material breach of these provisions, the Contractor (or subcontractor, regardless of tier) shall be entitled to cure the breach within ten (10) days and provide evidence of such cure. Should the breach not be cured, the County shall be entitled to all available remedies, including termination of the contract, the requirement that a subcontractor be dismissed from performing work under the contract, and any and all damages permissible by law. The Bidder is required to submit the Electronic Bid Proposal, which must include electronic signatures via BidExpress. Subject to other applicable provisions herein, bids or proposals will be considered incomplete and ineligible to receive a contract award unless the following forms (copies are part of bid) are completed and submitted with bid.: 1. Bid Bond or Certified Check (All proposals shall be accompanied by a Bid Bond or Certified Check drawn in favor of the Board of Commissioners of Cobb County, Georgia, in the amount of at least five percent (5%) of the bid for the complete work: such Bid Bond representing that the Bidder, if awarded a contract, will promptly enter into a contract and furnish a Performance Bond, in an amount equal to one hundred percent (100%) of the full penal sum of the Contract, and Payment Bond, in an amount equal to one hundred ten percent (110%) of the full penal sum of the Contract, as provided by law. The aggregate amount of the bonds shall be 210 percent (210%) of the full penal sum of the Contract. The Bid Bond shall be forfeited to the Board of Commissioners of Cobb County, Georgia, as liquidated damages if the Bidder fails to execute the Contract and provide Performance and Payment Bonds within ten (10) days after being notified of award of the Contract. In addition to the above requirements, nonresident contractors shall comply with the Georgia Nonresident Contractors Act, O.C.G.A. §48-13-30 et seq. A copy of the ten percent (10%) tax bond (or master or blanket bond) executed and filed with the Department of Revenue Commissioner shall be provided within ten (10) days after being notified of award of the Contract. 3.
