This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) subpart 5.2 - Synopses of Proposed Contract Actions. The U.S. Army Corps of Engineers (USACE), Seattle District intends to award a firm-fixed-price contract to the Montana Department of Environmental Quality (DEQ) for the issuance of Montana Pollutant Discharge Elimination System (MPDES) permits for Libby Dam in Libby, Montana.The statutory authority for this non-competitive acquisition is FAR subpart 13.106-1(b)(1)(i). A MPDES permit is issued by the State Agency in the state where the discharge occurs. The Montana DEQ is the only agency able to issue this permit in the State of Montana. Therefore, the Government believes that only one source can satisfy the agency’s requirement.Interested concerns must show authorization to issue MPDES Permits for the State of Montana. If no affirmative written responses are received by 10:00 AM Pacific Standard Time on December 30, 2019, an award will be made without further notice. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government.
