PURPOSE: The purpose of this bid invitation is to establish a contract for Natural Gas Generator Emissions Testing at the Edward Cross Training Complex. The resulting contract will bind the successful Bidder to the Department of Military Affairs and Veterans Services for services indicated in Sections 24 and 26 herein, in accordance with the requirements of this bid invitation and State and Federal laws and regulations. 2. INSTRUCTIONS TO BIDDER: Read the entire bid invitation prior to filling it out. Complete the “Total Bid Amount” section on the Bid Form below; complete the “Bidder Contact Information” section on the Bid Form below; and fill out, sign, and notarize the Bid Transmittal Letter on Pages 1 and 2 herein. 3. BID SUBMITTAL: All bids shall be submitted on this form (or an exact copy); shall be typed or clearly printed in ink; and shall be received on or before the date and time specified in Section 7 herein. BID INQUIRIES: All questions, clarifications, and/or requested changes (collectively referred to as “inquiries”) shall be submitted by an individual authorized to commit their organization to the Terms and Conditions of this bid via email to the following RFB designated Point of Contact: Tyler Carmichael Procurement Technician Page 4 of 14 Department of Military Affairs and Veterans Services Tyler.D.Carmichael@DMAVS.nh.gov Submissions shall clearly identify the bid number, the Bidder’s name and address, and the name of the person submitting the inquiry. Inquiries must be received by no later than the date and time listed in Section 7 herein. Inquiries received after the conclusion of the Bidder Inquiry Period, as specified in Section 7 herein, shall not be considered properly submitted and may not receive consideration or response. The Department intends to issue official responses to properly submitted inquiries on or before the date specified in Section 7, herein; however, this date is subject to change at the Department’s sole discretion. The Department may consolidate and/or paraphrase questions for sufficiency and clarity. The Department may, at its discretion, amend this RFB on its own initiative or in response to issues raised by inquiries, as it deems appropriate. Oral statements, representations, clarifications, or modifications concerning this RFB shall not be binding upon the Department. Official responses by the Department will be made only in writing by the process described herein. Bidders shall be responsible for reviewing the most updated information related to this RFB before submitting a bid. From the date of release of this RFB until a successful Bidder has been publicly awarded the contract, all communication with personnel employed by or under contract with the Department regarding this RFB is forbidden unless first approved by the RFB Point of Contact listed herein. Department employees have been instructed not to hold conferences and/or discussions concerning this RFB with any potential Bidder during the selection process, unless otherwise authorized by the RFB Point of Contact listed herein. Bidders may be disqualified for violating this restriction on communications. 5. BID CLOSING DATE: All bid submissions must be received by the Department of Military Affairs and Veterans Services no later than the Closing Date and Time specified in Section 7 herein. Submissions received after the specified date and time will not be considered. All offers shall remain valid for a period of one hundred eighty (180) days from the Closing Date specified in Section 7 herein. A Bidder’s disclosure or distribution of bids other than to the Department of Military Affairs and Veterans Services may be grounds for disqualification. 6. ADDENDA: The Department reserves the right to amend this RFB at its sole discretion, prior to the Bid Closing Date and Time as specified in Section 7 herein. In the event an addendum to this RFB is published, the Department, at its sole discretion, may delay the Bid Closing to another date and time. It is the Bidder’s responsibility to maintain awareness of any addenda or other materials affecting this RFB that may have been published to the State of New Hampshire Purchase and Property website prior to the Bid Closing. Page 5 of 14 7. TIMELINE: The timeline below is provided as a general guideline and is subject to change. Unless stated otherwise, consider the dates below a “no later than” date. TERMS OF SUBMISSION: All material received in response to this bid shall become the property of the State and shall not be returned to the Bidder. The State reserves the right to use any information presented in any submission. The content of each bid shall become public information once a contract(s) has been awarded. A responding bid that has been completed and signed by an authorized representative of the Bidder shall constitute the Bidder’s acceptance of all State of New Hampshire terms and conditions and shall legally obligate the Bidder to these terms and conditions. A signed response further signifies that from the time the bid is published until a contract is awarded, no bidder shall offer or give, directly or indirectly, any gift, expense reimbursement, or honorarium, as defined by RSA 15-B, to any elected official, public official, public employee, constitutional official, or family member of any such official or employee who shall select, evaluate, or award the RFB. Furthermore, a signed response signifies that any terms and/or conditions that may be or have been submitted by the Bidder are specifically null and void and are not a part of this bid invitation or any awarded purchase order, even if said terms and/or conditions contain language to the contrary. The form P-37 Contract attached hereto shall be part of this bid and the basis for the resulting contract(s). The successful Bidder and the State, following notification, shall promptly execute this contract form, which is to be completed by incorporating the service requirements and price conditions established by the Bidder’s offer. Complete bids shall be filled out on the original documents and format that are included herein. Bidders may submit additional paperwork with pricing, but all pricing shall be stated on the documents and in the format provided herein. 9. CONTRACT TERM: The resulting contract is effective upon Governor and Council approval through June 30, 2023. 10. CONTRACT AWARD: Page 6 of 14 The award shall be made to the Bidder(s) meeting the criteria established herein and providing the lowest total bid on the bid form herein. The State reserves the right to reject any or all bids or any part thereof and add/delete items/locations to the contract. All award(s) shall be, in the form of a State of New Hampshire Contract(s). Successful Bidder shall not be allowed to require any other type of order, nor shall the successful Bidder be allowed to require the filling out or signing of any other document by State of New Hampshire personnel. 11. NOTIFICATION AND AWARD OF CONTRACT(S): On the closing date for this bid, the Department will hold a public bid opening. For Bidders wishing to attend the public bid opening, the names of the Bidders submitting responses and pricing shall be made public. Bid results shall not be given by telephone. Other specific response information shall not be given out. Bid results shall be made public after final approval of the contract(s). Bid results may also be viewed on the State of New Hampshire Purchase and Property website. 12. LIABILITY: The State shall not be held liable for any costs incurred by Bidders in the preparation of bids or for work performed prior to contract issuance. 13. PUBLIC DISCLOSURE OF BID OR PROPOSAL SUBMISSIONS: Generally, the full contents of any bid or proposal (including all materials submitted in connection with it, such as attachments, exhibits, addenda, and Bidder presentations) become public information upon completion of final contract with the selected Bidder. Certain information concerning bids or proposals, including but not limited to pricing or scoring, is generally available to the public even before this time, in accordance with the provisions of NH RSA 21-G: 37. Information submitted in response to this RFB is subject to public disclosure under applicable state and federal laws and regulations, as determined by the State, including, but not limited to, NH RSA Chapter 91- A (the “Right-to-Know” Law), after the award of a contract by G&C. Following the time of closing for this bid on the date specified in Section 7 herein, the Department will hold a public bid opening at which it shall disclose the name of the bidders which submitted timely bids and the prices offered. Notwithstanding the Right-to-Know law, no information concerning the contracting process, including, but not limited to information related to bids, communications between the parties or contract negotiations, shall be available until the resulting contract is approved by G&C, or, if the contract does not require G&C approval, until the contract is executed and a written notice to proceed has been issued. Any and all information contained in or connected to a bid or proposal that a bidder considers confidential shall be clearly designated in the following manner: If the bidder considers any portion of a submission confidential, they shall provide a separate copy of the full and complete document, fully redacting those portions by blacking them out, and shall note on the applicable page or pages of the document that the redacted portion or portions are “confidential.” Use of any other term or method, such as stating that a document or portion thereof is “proprietary”, “not for public
