Notice of Intent to Sole SourceContracting Opportunities Announcement Type: Special NoticeAnnouncement Number: NIST-NOI-23-02316Subject: Procurement of Acquired Data Solutions (ADS) – Data Acquisition and Control (DAC) System Maintenance and Repair ServicesThe National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under the authority of FAR 13.106(b)(1), with ADS Inc, located at 11900 Parklawn Dr STE 205, Rockville MD, for the DAC system maintenance and repair services. This equipment will be utilized by the Engineering Laboratory (EL), Engineering Laboratory Office at NIST Gaithersburg MD campus.Sole source determination is based on the need to maintain capabilities of the DAC system, a system in which was originally designed, constructed, commissioned, and significantly updated by ADS. The size and complexity of the DAC architecture, especially element of the customized Labview Code, are substantial by design and would take other offerors
several weeks to decipher and much more to develop a preventative maintenance plan that would satisfy the government’s need.Based on market research, ADS Inc has been identified as the only company capable of meeting all of NIST’s requirement. Other commercially available products have been identified in the marketplace, however none are capable of meeting NIST’s minimum specifications in the timeframe required.*****The North American Classification System (NAICS) code for this acquisition is 334516 – Analytical Laboratory Instrument Manufacturing, with a small business size standard of 1,000 employees.*****A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.*****Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response due date for this notice.
