Phone: 267-784-0070 Description of Supplies or Services: The purpose of task order 36C25222N0273 is to provide facilities maintenance and general Architect and Engineering temporary professional services employees. The facility has been unable to hire permanent staff for these positions given the current job market and was in need of hiring temporary professionals to complete needed tasks at the facility. The need to replace several unsuitable workers was not anticipated. Modification 00001 is needed to add hours to line items 0001 (general maintenance workers) and 0002 (general Architect and Engineering services) so that started tasks can be completed. All hours worked will be within VA regulation 5 CFR Subpart E- Use of Private Sector Temporaies; the period of performance is not affected. The estimated value of the proposed action is $ 188,652.36 Authority: Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. Rationale/explanation to support cited authority: This requirement was solicited twice (SDVOSB Set-aside 36C25222Q0250 no responses; VOSB Set-Aside 36C25222Q0291 one response) receiving one response from VOSB Veterans Professional Services. Given that, it is unlikely that a new Offeror would be able to satisfy this requirement. Additionally it would not make sense to hire another company at this point as doing so would put additional cost and burden on the Government. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
