This is not a request for quotations or an announcement of a forthcoming solicitation, but merely notification of Customs and Border Protection’s (CBP) intent to issue, on a sole-source basis, a firm fixed-price delivery order to Reed Elsevier, Inc., DBA: LexisNexis. CBP will award a sole source, firm-fixed price delivery order to LexisNexis for an on-line annual subscription to the LexisNexis law enforcement, legal and business database services that include Lexis+, including Regulations Compare and Shepard’s at Risk; LexisNexis Dossier Suite: Lexis Nexis Headnotes; Matthew Bender Publications that include legal treatises, practice guides, legal forms; CourtLink; and News services from national, regional, and local newspapers. Award will be made against their Library of Congress/FEDLINK Indefinite Delivery Indefinite Quantity (IDIQ) Contract no. LCFDL19D0028. The period of performance will be January 1, 2023 through December 31, 2023. Under the authority of Federal Acquisition
Regulations (FAR) 16.505(b)(2)(ii)(B), when supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided. The Lexis.com, CourtLink and Accurint databases are only available from its producer and manufacturer and not through dealers or distributors.The Office of Information Technology (OIT) Information Resource Center (IRC) is responsible for the coordination and consolidation of information management and research services that are made available to CBP legal and law enforcement personnel agency wide. The CBP Office of Trade, Office of Chief Counsel, Office of Professional Responsibility, Office of Intelligence and other CBO offices require online access to legislative and regulatory content, professional insights, data analysis tools, and resources for policy professionals. A determination by the Government to not compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered for the purposes of determining whether to conduct a competitive procurement in the future. The Government does not intend to pay for information provided in response to this notice. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. All responses shall be submitted via email to Darnell.F.Flowers@cbp.dhs.gov by 16:00 Hours EST on December 14, 2021.If the Agency does not receive an acceptable response to this announcement by the specified date, negotiations will be conducted with LexisNexis as the only source and a delivery order will be issued without any additional notices being posted.
