Sluice gate fabrication

US Army Corps of Engineers, Portland District intends to negotiate/award a sole-source, Firm-Fixed Price contract with Henry Pratt, LLC a Mueller Water Products, Inc. subsidiary.This requirement is for the purchase of one Adult Fish Collection Sluice Gate fabricated of carbon steel with stainless steel trim as produced by Henry Pratt, LLC. This sluice gate will replace existing case iron sluice gate. Original sluice gate was originally manufactured by ARMCO. This procurement is brand specific as only Mueller Water Products and their subsidiaries Hydro gate and Henry Pratt, LLC have the original cast iron gate design and therefore has propriety information on dimensions. The new gate must work with the existing wall-mounted thimble and the existing operator.The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106- 1(b) for purchases not exceeding the simplified acquisition threshold. Furthermore, in accordance with FAR 6.302-

1(b)(1)(ii), the items listed below are available from only one source. Hydro Gate has propriety drawings.A SOLICITATION WILL NOT BE POSTED.THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concernsmust show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting  officer before the notice end date. If no affirmative written responses are received by 12:00 PM, Pacific Daylight Time on January 21,202, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
