CONTRACT PROVISIONS and SPECIFICATIONS For: PUBLIC WORKS MAINTENANCE MATERIALS 2024 SKAGIT COUNTY DEPARTMENT OF PUBLIC WORKS Bid Opening: February 12th, 2024, at 2:00PM 1 SKAGIT COUNTY MOUNT VERNON, WASHINGTON Call for Bids for Maintenance Materials – 4/1/2024 – 3/31/2025 (With annual purchases expected to exceed $25,000) Sealed Bids will be received and publicly opened in the Commissioners’ Hearing Room, Skagit County Administration Building, Mount Vernon, Washington, on February 12th, 2024, at the hour of 2:00 PM, or as soon thereafter as possible, for the following products for Skagit County: 1. Liquid Asphalt 2. Gravel Products 3. Rock Products 4. Specialty and Mixed Asphalt Products 5. Concrete Products The purpose of this Call for Bids is to solicit bids for the procurement of Maintenance Materials for use by Skagit County beginning on April 1st of 2024 through March 31, 2025. As per RCW 36.32.256, the County reserves the right to award the bid to more than one vendor, per item,
when hauling distance is a factor. A purchasing contract, or a series of contracts, will be entered into for purchases of one item totaling over $25,000 per year. The County Representative, when making purchases, will consider Price, Quality and Availability of the product. Skagit County requires materials of the highest quality available. To provide a standard for comparisons on required delivered items, unless otherwise indicated by the bid specifications for the individual items, suppliers are to quote a delivered price to the Burlington Yard, located at 201 E. Avon Avenue, Burlington, Washington. The County agrees to be billed for additional freight charges for deliveries made to locations other than the Burlington Yard. Some potential suppliers may deliver a product in their own trucks and present an all-inclusive invoice, effectively showing the delivered price. Other potential suppliers may have the product delivered by common carrier. Suppliers using common carriers must pay all the freight invoices, so essentially, they must incorporate product and freight charges in one all-inclusive bid price. All gravel and rock sources within Skagit County must be legally permitted and in compliance with all the provisions of the Skagit County Zoning Ordinance and any other applicable regulations. Upon request, vendor will be required to submit, within 24 hours, proof of compliance with Skagit County Zoning Ordinance requirements. Sealed bid envelopes must be clearly marked on the outside, “Call for Bids for Maintenance Materials, to be opened at 2:00 PM, February 12th, 2024” and must be delivered to the office of the Skagit County Commissioners prior to bid opening time. Bid Opening: February 12th, 2024, at 2:00PM 2 SKAGIT COUNTY MOUNT VERNON, WASHINGTON General Information Questions All technical questions regarding Maintenance Materials are to be submitted no later than 9:00 a.m., Friday, February 2, 2024 in writing to Jason Bloodgood, ER&R Manager, or by e-mail jasonb@co.skagit.wa.us with the subject line reading, “Maintenance Materials 2024”. All project specific questions and response to answers for Maintenance Materials will be available on-line as received. All Addenda will be posted on-line for this Project by 5:00 p.m. on Monday, February 5, 2024. If further Addenda are required to be issued, the bid opening will be postponed. Pre-season meeting A pre-season meeting will be required for material vendors and freight companies who we enter into contract with. The purpose of this meeting will be to discuss several items including but not limited to: Exchanging contact information, delivery guidelines both in the Burlington yard and out on the job site, and punctuality. Canadian Bidders Canadian bidders must quote prices in U.S. tons and U.S. dollars. Canadian bidders must include in their bid price all U.S. and/or Canadian customs charges to be levied against delivered products entering the United States. Skagit County will not pay any additional entry charges. Execution of Contract Within twenty (20) calendar days after the award date, the successful bidder shall return the signed contract, all required insurance certifications, and any other required documentation as specified in this document. Skagit County may grant up to a maximum of ten (10) additional calendar days after the award date for return of the documents, provided that the Contractor makes such a request in writing and that Skagit County deems the circumstances warrant it. Failure to Execute Contract Upon failure to return the insurance certifications with the signed Contract as required, Skagit County may then award the contract to the second lowest responsible bidder or reject all remaining bids. Indefinite Delivery – Indefinite Quantity Skagit County does not guarantee any specific maximum or minimum amount of product to be purchased under the contract. Quantities are estimates only and are not to be construed as firm or a guaranteed purchasing obligation on behalf of Skagit County. mailto:jasonb@co.skagit.wa.us Bid Opening: February 12th, 2024, at 2:00PM 3 SKAGIT COUNTY MOUNT VERNON, WASHINGTON Item 1: Liquid Asphalt General Liquid Asphalt products shall meet the requirements of Division 9, Section 9-02 of the Washington State Department of Transportation (WSDOT) Standard Specifications for Road, Bridge, and Municipal Construction. The point of acceptance shall be the point of delivery. The County expects to purchase approximately 3,000 tons of various Liquid Asphalt Products during the proposed time period. The Prices that you enter shall include freight to the Burlington yard, located at 201 East Avon, Burlington, Washington. Prices should also include the required material testing by the contractor. Please exclude sales tax in this bid. Delivery Skagit County requires notification at (360) 416-1490 prior to delivery to the Burlington yard. To be eligible for bid award, the bidder must be capable of providing on-time truckload delivery to various job sites in Skagit County as ordered during the summer of 2023 road asphalt leveling and road oiling season, normally May through August. During peak season, the County may require up to five (5) trucks available for deliveries four days (Monday – Thursday) a week. Trucks will transfer liquid asphalt to the County oiling equipment on site or to the Burlington yard storage tanks. Upon delivery, emulsion temperature shall have a minimum temperature of 150 degrees Fahrenheit and a maximum of 180 degrees Fahrenheit. Short Load / Minimum Load Charge In the event that the county orders less than a full load, a short load / minimum load charge may be applied to orders under 3,000 gallons and needs to be noted on the table on page 6. The County will not pay short load charges on deliveries over 3,000 gallons as the County’s holding tank for CSS-1 is 3500 gallons. Cancellation of Loads The County may cancel pre-scheduled deliveries by notifying the vendor by telephone a minimum of five (5) hours prior to delivery time and incur no cancellation charges. The vendor will be required to provide the County with a 24-hour telephone number for emergency cancellations. Testing / Right of Refusal All shipments of liquid asphalt shall be tested to verify that the products are within the required specifications by the vendor prior to delivery. Test result must be e-mailed to jasonb@co.skagit.wa.us (Equipment Division Manager) AND johnd@co.skagit.wa.us (Operations Division Manager) prior to delivery. Shipments will also be sampled at the point of acceptance and sent to a private materials laboratory for testing. After placement and testing, any shipment that does not meet the specifications shall be discounted at a rate based upon the WSDOT Quality Assurance Price Adjustments. Additionally, the Skagit County Public Works Road Operations Division Manager shall have the authority to reject any shipment in its entirety based upon a visual inspection of the material placed on the roadway. The rejected shipment will not be paid for if it does not meet specifications identified on the price sheet. The County reserves the right to terminate contracts with thirty days written notification for unsatisfactory performance or other significant change. Additional Products Available The Contractor may also include an additional products available list. This list should include any products readily available for the County to purchase. The County will review these items to verify the best product for each application. Item 1: Liquid Asphalt (continued on next page) Bid Opening: February 12th, 2024, at 2:00PM 4 Item 1: Liquid Asphalt (continued) Standby Time The County realizes that events such as equipment breakdowns and unforeseen traffic delays may occur during the annual oiling season. The vendor should promptly notify the County of all delays by telephone, cell phone, radio dispatch or any other means of communication. Every attempt will be made to find a reasonable solution to these delays. The County retains the right to invoke a standby charge up to $1,800 per hour on a case-by-case basis, should a delivery be delayed beyond a reasonable time frame. If such standby charges are invoked the County will e-mail any standby charges caused beyond a reasonable time frame to the vendor for payment to Skagit County. The trucking company must be available by cell phone 24 hours per day. Change Orders Skagit County reserves the right to add or delete work, items, agencies, or locations from this contract, subject to appropriate adjustments to the contract price. Added items, agencies or locations will be related to those on contract, and additions or deletions will be by mutual agreement, with prices consistent with the original bid price margins, and evidenced by a written contract change order from the Skagit County Engineer or their designee. The execution of a change order shall constitute a waiver of claims by the Contractor arising out of the work to be performed or deleted pursuant to the change order, except as specifically described in the change order. General reservations of rights will be deemed waived and void. Demurrage You are required to provide an additional price list for mileage (freight charges beyond Burlington Yard) and demurrage with your bid. For a standard prearranged delivery, the County will have 2.5 hours to unload a delivery of 7,000 gallons (29 tons) or less. Deliveries of 7,000 gallons (29 tons) or greater the County will have 3 hours to unload the delivery. If the delivery should arrive late, the demurrage charge will begin 3 hours after arrival. Subsequent demurrage will be offset to reflect the first late truck. In order to be considered for payment, all demurrage claims must be agreed upon and signed by a Skagit County representative on the day of delivery, before the driver leaves the work site.
