The Agency, subject to Board of Directors' Approval, intends to award a Contract to the Successful Proposer for approximately eighteen (18) month base term for the Pre-construction Phase, with an option to issue Amendment for another eighteen (18) month term to execute the Construction Phase if the parties agree on a Total Contract Price (TCP). The Successful Proposer will
execute an Agreement for Services, please refer to upcoming solicitation document for details. The Agency’s current Utility Work estimate escalated to the mid-point of Utility Work construction is sixteen million five hundred eighty thousand dollars ($16,580,000). The Agency’s current construction estimate not including utility relocation Work escalated to the mid-point of construction is twenty million one hundred twenty thousand dollars ($20,120,000). The proposed Construction Phase Firm Fixed Fee Lump Sum Price shall not change regardless of the negotiated TCP, unless Approved by the Agency as further detailed in the upcoming Solicitation. The Construction Phase Work described in this solicitation is considered a public works project subject to the State of California Labor Code and Prevailing Wage Laws when construction services are added to the Contract. A single Proposal is requested for both Pre-Construction Phase and Construction Phase Services solicited by this RFP. Selection will be on a best value basis, in accordance with the evaluation criteria set forth in the RFP. The Agency has a Disadvantaged Business Enterprise (DBE) program to encourage the participation of DBEs and Small Business Enterprises (SBEs) on contracts. The agency has an overall DBE goal of 12.8%. Although there is no contract-specific DBE goal for this RFP, the Agency may assign a DBE goal to the optional services tasks described in this RFP. Proposers and their proposed subcontractors shall hold such licenses as may be required by the laws of the State of California for the performance of the work specified in the Contract Documents. Proposer proposing as the CM/GC Contractor shall possess a valid California State Contractor’s License, Class A (General Engineering) at the time of Contract award and throughout the contract term. The CM/GC Contractor will also be required to ensure that all subcontractors working on the Project are holding valid licenses suitable for their trade.
