J&A 6.203-1. The Internal Revenue Service (IRS) intends to make a Sole Source award to Quest Diagnostics for the purchase of Nucleic Acid Amplification Tests (NAAT) Polymerase Chain Reaction (PCR) and Rapid Antigen tests. The primary statutory authorities for permitting other than full and open competition are Title III of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act [41 U.S.C. 251] and 41 U.S.C. 3304(a)(1) which authorizes other than full and open competition when there is only one Responsible source.The IRS has a need for the commercial services of a dedicated laboratory testing provider, who shall provide “at home” COVID-19 Rapid Antigen Card Home Test, a self-administered, nasal swab antigen test that provides results in 15 minutes. Contracted clinicians will supervise the testing process virtually, confirming employee identity, overseeing proper sample collection, and authenticating results during a telehealth visit. The IRS’s requirement is for proctored testing with home rapid antigen testing. This is not a solicitation for proposals or an invitation for bids. The Government does not anticipate receiving responses to this notice of a non-competitive action. If parties choose to respond, responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency however, any cost associated with the preparation and submission of data or any other costs incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government. All information received will be solely evaluated for purposes of determining whether to conduct a competitive acquisition if necessary.
