Federal Acquisition Regulation as indicated in the attached SF18.  The SF18 form is being utilized to generate the applicable clauses from the Standard Procurement System. This requirement is not eligible for small business set-aside.The Naval Surface Warfare Center, Dahlgren Division (NSWCDD), intends to procure on a Brand Name or Equal basis for 12 months of DirectTV Network Satellite Support for various department programs (see attached SF18), provided by DirecTV, LLC.  DirecTV is located in El Segundo, CA 90245-3501.The current equipment is proprietary technology to DirectTV Network and is incompatible with any other satellite service for television programming. Utilization of any other service provider would require removal and replacement of existing equipment which includes new satellite dishes and receivers resulting in additional cost of approximately $12,500.00 and downtime of four (4) days. This additional cost could not be recovered through full and open competition.All reseller/dealer offerors must be able to bill and collect on behalf of DirecTV and must submit authorized reseller/dealer letters in order to prevent your quote from being excluded.Please include shipping/freight cost to Dahlgren, VA 22448-5114. Simplified Acquisition Procedures (SAP) will be utilized for award in accordance with FAR Part 13.  The order shall be firm fixed price.  All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.  The completion and submission to the Government of an offer shall indicate the Offeror’s unconditional agreement to the terms and conditions in this solicitation.
