INTRODUCTION AND BACKGROUND The Gwinnett County Board of Commissioners has authorized the use of $4.5M in federal grant funds allocated by the American Rescue Plan Act (ARPA) and $948,814 from the CARES Act Community Development Block Grant (CDBG-CV) (which includes compensation to the SBAP vendor) for the provision of grants to small businesses in need of economic assistance due to the COVID-19 pandemic. As such, the County is requesting proposals from eligible vendors to further define their capacity to administer the SBAP for the County. The County’s goal is to publicize the program as soon as possible in the first quarter of 2023, notifying the public of funding availability and defining application requirements and then releasing applications one month after announcement of the program, closing the application period two months after it opens, with the expectation that funding to eligible small businesses will begin to be disbursed within one month of the close of the application period. II. SCOPE OF WORK The requisite services and requirements are, at a minimum, to include the administration of small business assistance grants to include the following: • Administer funding in compliance with all Federal, State, Local rules and regulations. • Application Management o Development o Acceptance o Eligibility Determination o SAM.gov Verification • Technical Assistance to applicants • Award Management o Review of applicant pool to determine award recipient eligibility categories and grant amounts o Contract/Agreement development o Payment request and/or release of funds • Reporting o General Information  Applications Received  Applications Awarded  Applicant Details • Business Type/Size/Location/etc. o Participant Reporting  Use of funds  Beneficiaries • Records Maintenance • Audits/Monitoring The County is considering the following concepts within its Small Business Assistance Program: • Grant awards will be targeted toward the hardest hit sectors RP038-22 PAGE 3 • Award grant amounts based on a defined formula (ex. employee count, revenue, and sector impact), to be determined through an underwriting process at the conclusion of the application period • Assistance should be based on demonstrated need, per relevant ARPA rules and CDBG rules, as applicable, including restricting 51% of the CDBG-CV funds for qualified low- to moderate-income businesses • Applicants are prohibited from applying for any loss in revenue, incurred cost, or hardship that they have previously received federal pandemic response funding for. Applicants will be required to identify the source and use of any past federal pandemic funding awards and attest that their SBAP application is not duplicative to any previous awards. • Business must be located in Gwinnett County. Please define your firm’s approach to provide these requested services. Be sure to highlight your staffing capacity to meet the proposed timelines. XXVI. ALTERATIONS OF SOLICITATION AND ASSOCIATED DOCUMENTS Alterations of County documents are strictly prohibited and will result in automatic disqualification of the firm’s solicitation response. If there are “exceptions” or comments to any of the solicitation requirements or other language, then the firm may make notes to those areas, but may not materially alter any document language. XXVII. TAX LIABILITY Local and state governmental entities must notify contractors of their use tax liability on public works projects. Under Georgia law, private contractors are responsible for paying a use tax equal to the sales tax rate on material and equipment purchased under a governmental exemption that is RP038-22 PAGE 31 incorporated into a government construction project: excluding material and equipment provided for the installation, repair, or expansion of a public water, gas or sewer system when the property is installed for general distribution purposes. To the extent the tangible personal property maintains its character (for example the installation of a kitchen stove), it remains tax-exempt. However, if the installation incorporates the tangible personal property into realty, e.g., the installation of sheetrock, it becomes taxable to the private contractor. See O.C.G.A. 48-8-3(2) and O.C.G.A. 48-8-63 XXVIII.
