FBO Notice:The Food and Drug Administration (FDA), Office of Acquisitions and Grants Services has received a Justification for Other than Full and Open Competition to execute a modification for continued services for a contract to a State Agency, Georgia Department of Revenue, to assist in inspecting retail establishments that sell cigarettes and/or smokeless tobacco products and in surveillance of other entities that fall under the scope of the Tobacco Control Act. This procurement action is for the acquisition of sole source noncommercial services using negotiated procedures in accordance with FAR Part 15. The North American Industrial Classification System (NAICS) number is 923120 - Administration of Public Health Programs.All interested parties MUST be an agency or subdivision of a state, territory, local, or tribal government that has the power to create, enforce, or administer rules or policies that govern the conduct of individuals or other private entities such as small
businesses.The proposed contract action is to prevent a lapse of service between the current contract and the upcoming contract for which the Government intends to solicit and negotiate with only the State of Georgia under the authority of 41 U.S.C. 3304(a)(5). The contract period of performance is March 12, 2018 - June 11, 2018. This notice is issued for informational purposes and is not a request for competitive proposals. DO NOT submit a bid/quote at this time.Any offerors believing they can provide the required tobacco inspections described above shall provide evidence for consideration. Evidence must support the offeror's claim they can provide these services. A capabilities statement and/or a statement of intent to include a description of your legal authority, organizational capability, and staffing capacity to conduct tobacco compliance check inspections, a point of contact, official agency name, address, and valid DUNS number.The Government does not intend to pay for any information provided under this announcement.
