DLA Energy, in conjunction with the United States Navy, plans to offer the privatization of the Water (NAICS 221310) and Wastewater (NAICS 221320) utility systems at Naval  Air Station Patuxent River, Maryland.Utilities Privatization (UP) is defined as the transfer of ownership and responsibility to a municipal, private, regional, district, or cooperative utility company or other entity, for the operations, maintenance, repair, future upgrades, and future utility systems replacements.  The conveyance may consist of all right, title, and interest of the United States in the utility system.  UP will be accomplished in accordance with 10 U.S.C. §2688 – Utility Systems: Conveyance Authority. As a result of this solicitation, the Contractor(s) will be selected to assume ownership of the Water and Wastewater utility systems.  The new owner(s) shall operate and maintain the system and provide utility services to the Government.  Any resulting contract, if awarded, will require the Contractor
to furnish all facilities, labor, materials, tools, and equipment necessary to own, maintain, and operate the utility system.  All responsibility for maintaining reliable service, including such items as environmental compliance, maintenance costs, major system renovations, construction, equipment, manpower, and overhead costs shall become the utility system owner’s responsibility.  The Contractor shall manage the maintenance, repairs, replacement, etc., of the system to ensure continuous, adequate, and dependable service for each Government or tenant connection within the service area.  The Contractor shall be responsible for funding all capital investments required to acquire, maintain, and operate the utility system in a safe, reliable condition and to meet the requirements listed in the contract. Real property interests will be conveyed in the form of a Right of Access or an Easement as a reference to the resultant contract.  The utility system will be conveyed via a Bill of Sale after a transition period to be determined by the Contractor.  Past performance information from potential offerors shall be submitted as directed in the solicitation.A Sources Sought Notice for this requirement was previously publicized under solicitation number SP0600-20-R-0803 on March 17, 2020.  The Sources Sought Notice has closed and market research is complete.  This requirement will be unrestricted.  All responsible sources are encouraged to submit an offer.  Secure DocumentsAs this requirement will be an unrestricted, competitive action, several of the solicitation documents will be posted as “secured” on the beta.SAM.gov website.  In order to view those documents, vendors will need to obtain special access.  The process of obtaining access is somewhat lengthy, therefore all interested vendors are encouraged to begin that process as soon as possible.  Instructions for obtaining access are provided below.Should any party have issues with obtaining access to beta.SAM or the secure documents, they must notify the contracting office no later than October 13, 2020.  Notifications to the contracting office of the inability to access secure documents after that suspense will not be a consideration in extensions to the Request for Proposal date.  Instructions to Access Secure Attachments in Contract OpportunitiesTo access the secured, but unclassified, documents in the beta.SAM system, offerors must:Have a DUNS number.  To acquire a DUNS number call 1-866-705-5711 or visit the Dun & Bradstreet (D&B) website https://fedgov.dnb.com/webform/displayHomePage.do to register or search for a DUNS number.Users are required to be registered in SAM.  A CAGE Code is also created through the SAM registration process at https://www.sam.gov/SAM/Users must create a login.gov account in beta.SAM.gov.  Instructions are below.  For additional help, contact the Federal Service Desk at www.fsd.gov or toll free at 1.866.606.8220.To link to an existing login.gov accounta. From https://betaSAM.gov go to sign in on the toolbar.b. Enter an email address and password for your existing login.gov account.c. Users will then receive an email to associate your existing login.gov account with beta.SAM. Users will now use this login.gov account to sign into beta.SAM.gov. New users will be asked to complete their beta.SAM.gov profile.2. To create a new login.gov accounta. From https://beta.SAM.gov/ go to sign in on the toolbarb. Select create an accountc. Enter an emaild. Users will receive a link with a security code via email. Go to the link and enter that security code and press continue.e. Create a password. Press continue.f. Select the method by which you wish to receive one-time security codes in the future. Users will be notified of the response to the request.d. Please note that Users will now need to request access for each attachment individually.4. Parties who already have JCP Certification are encouraged to verify their information in the JCP system at https://public.logisticsinformationservice.dla.mil/jcp/search.aspx .  Incorrect information may result in rejection of request and delays in access to controlled documents.5. Instructions for obtaining JCP certification or for correcting a current JCP certification are as follows:a. Applicants for JCP certification are required to have a current DUNS Number, SAM registration, CAGE Code, and login.gov accountb. Download the DD Form 2345, Military Critical Technical Data Agreement by clicking on a controlled attachment in the solicitation listing or by accessing the form through the link on https://www.dla.mil/HQ/LogisticsOperations/Services/JCP/ or directly at https://www.esd.whs.mil/Portals/54/Documents/DD/forms/dd/dd2345.pdfc. Complete the DD2345 form and submit a hard copy of the original form, together with all required documentation, to the Defense Logistics Information Service (DLIS), U.S./Canada Joint Certification Program (JCP), at the address listed on the form.  Alternately, the completed, signed, and dated DD2345 can be emailed as a .pdf file with supporting documentation to: jcp-admin@dla.mil.
