Regulations dealing with oil and other hazardous substance pollutions control and oil spill financial responsibility were adopted by the Department of Environmental Conservation on March 4, 2021, with an effective date of June 24, 2021. The regulations have been made permanent and have been filed by the Lt. Governor. The regulations will appear in Register 238, July 2021, of the Alaska Administrative Code. The regulations changes are summarized as follows:
The Alaska Department of Environmental Conservation is required by AS 46.04.040 – 045 to adjust the dollar amounts of financial responsibility for spill response in accordance with changes in the Anchorage Consumer Price Index (CPI). The proposed changes would increase the minimum dollar amounts for proof of financial responsibility required from oil industry operators, railroads and non-tank vessels.
