NOTICE OF ADOPTION OF EMERGENCY REGULATIONON RESPONSE TO COVID-19 OUTBREAK OF MARIJUANA CONTROL BOARDOn November 23, 2020,
the Marijuana Control Board adopted, as an emergency regulation, changes in 3 AAC 306 of the Alaska Administrative Code dealing with
COVID-19 outbreak, including the following:(1)        3 AAC 306.305(a) and 3 AAC 306.310(a) add language to allow for Internet and phone orders; exterior window and curbside pickup service permitted under 3 AAC 306.995.(2)        3 AAC 306.995 allows for Internet and phone orders, exterior window and curbside pickup until the expiration of the governor’s November 6, 2020, COVID-19 public health emergency disaster declaration or any extensions or renewals of the declaration. It outlines privileges, requirements, and responsibilities of the marijuana retail store licensee providing the service. It defines “curbside pickup” and “exterior window pickup” for the purposes of this regulation. The emergency regulation took effect
November 24, 2020, and will expire March 23, 2021. The Marijuana Control Board intends to make the emergency regulation permanent.You may comment on the regulation changes, including the potential costs to private persons of complying with the changes, by submitting written comments to Marijuana Control Office at 550 West 7
th Avenue, Suite 1600, Anchorage, AK 99501. Additionally, the Marijuana Control Office will accept comments by electronic mail at
amco.regs@alaska.gov.  Comments also may be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the comment link.
The comments must be received not later than 4:30 p.m. on January 4, 2021. You may submit written questions relevant to the proposed action to Marijuana Control Office by electronic mail at
amco.regs@alaska.gov or 550 West 7
th Avenue, Suite 1600, Anchorage, AK 99501. The questions must be received at least 10 days before the end of the public comment period. The Marijuana Control Office will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and AMCO’s website. The Marijuana Control Office may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.If you are a person with a disability who needs a special accommodation in order to participate in this process, please contact Alcohol and Marijuana Control Office at 907-269-0490 not later than December 14, 2020, to ensure that any necessary accommodation can be provided.A copy of the emergency regulation is available on the Alaska Online Public Notice System or by contacting Alcohol and Marijuana Control office at
amco.regs@alska.gov or 907-269-0490.The language of the permanent regulation may be different from that of the original emergency regulation and may include other provisions dealing with the same subject.
