DEPARTMENT OF VETERANS AFFAIRS Justification for Brand Name Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-23-AP-3940 Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office in Kettering, Ohio has been requested by the John D. Dingell VAMC, Detroit, MI to procure TFL PREMIUM LASER SYSTEM - SOLTIVE. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This request is to purchase the following TFL PREMIUM LASER SYSTEM SOLTIVE: Estimated Cost: Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Soltive Premium SuperPulsed Laser System is used for incision, excision, resection, ablation, coagulation, hemostasis and vaporization of soft tissue with or without an endoscope for urology, lithotripsy, gastroenterological surgery and gynecological surgery. The Soltive
laser is the only Thulium laser on the surgical market at this time. Description of market research conducted and results or statement why it was not conducted: VetCert/DSBS all were searched using NAICS Code 334510; VetCert provided 293 vendors that could potentially provide this equipment/supplies. However, using the same NAICS Code and adding the key word Laser in DSBS, 1 vendor was identified and potentially able to provide the requested items. However, further research in GSA Advantage, eCMS, SCMC, SAM, and FPDS, provided further information on this equipment. The OEM, Olympus, a LB was found in GSA, as able to provide this specialized equipment. Additional research found that Olympus has at least one SDVOSB vendor who has authorized distributor authority to provide these items. The SDVOSB pricing is exactly the same as the OEM, with no additional mark-up for the requested equipment. Solicitation should be placed in Contract Opportunities, as an unrestricted RFQ on the open market. Additionally, the NAICS Code was found in the NMR Class Waiver Listing, so this solicitation will be competed Open Market as a SDVOSB Set-Aside. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
