NOTICE OF SALE Department of Natural Resources & Conservation Timber Sale The East of Emerald Timber Sale is located within Sections 28 & 34 of T16N-R14W on the State's Clearwater Unit. Approximately 13,359 tons, consisting primarily of Douglas-fir sawlogs, are offered for sale. Sealed bids will be opened at the Department of Natural Resources & Conservation, 2705 Spurgin Road, Missoula, Montana on June 14, 2022 at 2:00 p.m. Bids may be hand delivered or mailed and will be accepted any time prior to the bid opening. DNRC recommends that bidders contact the Trust Land Management Division (406-542-4300) prior to the bid opening to ensure that your bid has been received. Bids must be accompanied by a deposit of $10,921.00, representing 5% of the minimum bid value of the sale in cashier's check, certified check, bank money order or bank draft to be applied to the first sale invoice for the successful bidder. Bid bonds will be accepted and, for the successful bidder, will be
closed upon execution of the Timber Sale Contract and Timber Sale Bond. The sale will be awarded to the highest responsible bidder. Award of the timber sale is conditional upon approval of the timber sale by the State Board of Land Commissioners at their May 16,2022 meeting. If the successful bidder is unable to execute the contract within 30 calendar days from the date the sale is awarded, the bid deposit will be retained by the Department as liquidated damages. The right is reserved to reject any or all bids. Bids must be submitted on Department of Natural Resources & Conservation (State) bid forms. 2. Timber will be sold to the highest responsible bidder; however, the State reserves the right to reject any or all bids. 3. The State recommends that bidders contact the Forest Management Bureau, Trust Land Management Division (406-542-4300) prior to the bid opening to ensure that your bid has been received. 4. A Bid Deposit must accompany all bids and must be in the form of cash, cashiers check, certified check, money order, bank draft, surety bond or irrevocable letter of credit. 5. The Purchaser must submit a Performance Bond to the State within 30 days of notification of sale award. The bond amount will be, at a minimum, 20% of the total bid value of the sale. The performance bond may be cash, irrevocable letter of credit, surety bond or certificate of deposit. The performance bond must be maintained separately from other payments for the duration of the Timber Sale Contract. See the Timber Sale Contract for additional information. 6. The purchaser must submit an Advance Stumpage Payment prior to cutting any timber. The amount of the advance stumpage payment will cover six weeks of harvesting and be based on the expected harvest rate and the bid value of the stumpage. The advance stumpage payment may be cash, irrevocable letter of credit, payment bond or certificate of deposit. 7. At rates specified in the Contract, the purchaser will pay Forest Improvement Fees on all sawlog volume. All applicable Road Use and/or Maintenance fees will also be paid by the Purchaser in addition to stumpage payments. 8. This sale is being sold based on the gross weight of all species. Minimum price and bid price are on a per ton basis. Unless otherwise specified, the price applies to all species, green and dead. Price may vary by product. Billing will be based on gross weight. A weight ticket from a certified scale is required for each load hauled, regardless of product type. 9. The State has estimated the net scale merchantable sawlog volume to be sold under this Contract. Other products may be part of this sale. All delivered wood will be weighed and billed at per ton bid rates. The State recognizes that a percentage of delivered wood may not meet the log manufacturing and recovery standards of the Timber Sale Contract. The actual percentage will vary based on the log manufacturing and recovery specifications of the purchaser and tree conditions in the sale area. The actual delivered weight may vary, resulting in an overrun or under-run of the estimated tonnage. The State strongly recommends that bidders evaluate these effects before bidding. 10. The State does not conduct detailed road appraisals. All appraised costs are gross estimates or averages, provided only to show the relative amount of work required, and not the true market value. The State strongly recommends that bidders make their own estimates based on Contract requirements. Cost estimates provided are not guaranteed. 11. PROSPECTUS Version January 2018 2 Additional Sale Information: 1. ROAD BUILDING AND MAINTENANCE – KEY POINTS • THIS PACKAGE INCLUDES ROAD BUILDING. 1.02 miles of new road construction is required. Please note, 0.95 miles of new construction must be completed by October 15, 2022. o Road work includes the procurement and installation of two new round pipe gates. o Road work includes the procurement and installation of two new 18”x30’ CMPs. o WEED SPRAYING: The Purchaser shall be responsible for weed spraying on approximately 9 miles of road post-harvest. o GRASS SEEDING: The Purchaser is required to supply up to 342 pounds of grass seed. o ROAD SEASON CLOSURE: No road maintenance or construction will occur from October 15 - June 15. Given the usual break-up conditions, July 1 is a normal beginning time. Exceptions may be allowed depending on conditions and approval of the Forest Officer. o Blackfoot Telephone Coop. Inc. has an easement for a buried telephone line in T16N R14W Sec 28. It is the responsibility of the purchaser to contact Blackfoot (1-800-424-5555) to have them mark the location of the buried line before beginning any excavation in this area. 2. LOGGING OPERATIONS – KEY POINTS TABLE 3. The entire sale is tractor ground with portions of the sale containing steeper slopes of 45-55%. • Three harvest units have an overhead powerline running through them. Use extreme caution during harvest operations. • OPERATING PERIOD: June 16 – March 1. Closures are for Grizzly bear closure (April 1 – June 15) and anticipated spring break-up conditions. No harvesting, hauling, road work, slash work, etc. will be allowed outside of the operating period unless authorized by the Forest Officer. o Two harvest units are located on the Blackfoot-Clearwater Game Range. These units will also have a seasonal closure for general rifle season, from October 15 to December 1. • THIS SALE IS SAMPLE MARKED: Each harvest unit contains sample-marked areas that provide examples of the desired prescription for that unit. Cutting guidelines for each unit are found in contract section VII.F. Unit Designations. A map is included that shows the location of the sample areas. Cruise plots were also marked for approximately 100 feet around plot center. Plot centers have been monumented with NEON GREEN and YELLOW/RED POLKA DOT flagging. The following requirements are necessary: O PRIOR TO BEGINNING HARVEST IN EACH UNIT, THE PURCHASER, CLIPPER OPERATOR AND THE FOREST OFFICER MUST VISIT THE UNIT AND DISCUSS THE PRESCRIPTION FOR THAT UNIT. O DURING HARVEST, IF THE FOREST OFFICER DETERMINES THAT THE DESIRED PRESCRIPTION IS NOT BEING MET, THE FOREST OFFICER, PURCHASER AND OPERATOR WILL BE REQUIRED TO DO A WALK- THROUGH OF THE ENTIRE UNIT TO EXPLAIN WHAT IS REQUIRED. Unhealthy trees (poor crowns, poor appearance, forked or damaged stems) that are greater than 5’’ DBH but not meeting SAWLOG MANUFACTURING AND RECOVERY STANDARDS, and that are not designated to leave, will be cut. Healthy trees with good crowns will be left. Scattered clumps of trees >5” DBH and 8” DBH can be left in the unit as wildlife habitat, however this needs to be approved by the Forest Officer and usually will be ½ acre. o The purchaser has the option of disposing of pulp by using one or a combination of the following methods:  Processing into a pulp log and hauling at the rate listed for Other Material/Pulp OR staging in a processed deck for purchase by others. • UNIT PILING: Is required in units 28-4 and 34-2 (75 acres) AND within 200 feet of all ownership lines with private property (approximately 40 acres). • LANDINGS AND LOG DECKS: If landing piles become too large, as determined by the Forest Officer, it may be required that slash be redistributed to the unit using “skidder piles”. These piles will be at least 8 feet tall and will be piled in a way as to promote burning (higher, NOT wider). The piles will be placed in openings at least 15 feet away from residual trees. • WETLAND MANAGEMENT ZONES: Three harvest units contain isolated wetlands. No streams are present within the sale area. • PURCHASER SLASHING OF LOGGING DAMAGED TREES REQUIRED: Purchaser shall fell all sub-merchantable trees with logging-related root or stem damage, causing lean. The stem shall be completely severed from the stump below the lowest live limb. Maximum stump height shall be 12 inches on the uphill side. • PURCHASER LOPPING REQUIRED: Purchaser shall buck and de-limb all logging slash as required to reduce main stems to within 12 inches of the ground from bottom side and reduce total slash depth, including branches, to within 18 inches of the ground. - - - *Bidders interested in accessing the sale area may contact Melissa Laskos at 406-244-2385 for gate access.
