The Centers for Disease Control and Prevention (CDCP), National Institute for Occupational Safety & Health (NIOSH), National Personal Protective Technology Laboratory (NPPTL) intends to award a sole source firm fixed price purchase order to: Deno, Scott, dba DEEC Systems. 135 Watson Road, State Colllege, PA 16801, for the DEEC Systems “ABMS Gold  Software License Purchase”.The National Personal Protective Technology Laboratory (NPPTL) of the National Institute for Occupational Safety and Health (NIOSH) and the Mine Safety and Health Administration (MSHA) in Pittsburgh, PA performs approval testing and post-market evaluation testing of mine escape respirators at NIOSH’s Automated Breathing and Metabolic Simulator Laboratory. The Automated Breathing and Metabolic Simulator is operated by a LabVIEW software application designed and owned by DEEC Systems. The current version of ABMS LabVIEW run-time software routines are locked, via password, and can only be edited by the current owner,
(DEEC Systems) of the software code.This purchase will give NIOSH full access to the software code including the ability  to edit the code for future enhancements. This will also enable NIOSH to gain a better understanding of the ABMS mass balance and operational calculation routines which will be helpful in guiding future revisions and upgrades to the software to improve ABMS accuracy and repeatability. DEEC Systems is the sole owner ofthe LABView software application that runs the ABMS. The license to gain access to the software subroutines can only be provided by DEEC Systems.This contract action is for commercial items prepared in accordance with the format in Subpart 12.6, which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) (SAP) and 41 U.S.C. 3304(a)(1). Interested persons may identify their interest and capability to respond to the requirement or submit proposals.This notice of intent is not a request for competitive quotations; however, all quotations/responses received within seven (7) days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.Any quotation/response should be emailed to James Ambrozic, contract specialist at email: eud7@cdc.gov by 11:00 AM (EST) Wednesday, 08 July 2020.
