All RFP submissions must be in the form prescribed by Ogle County, and must be made in accordance with the RFP. The RFP is available at the Office of the County Clerk at 105 South 5th St – Suite 104, Oregon, Il 61061 Monday through Friday between the hours of 8:30 A.M. and 4:30 P.M. at the address above, or
may be downloaded from the Ogle County website, www.oglecounty.org. NOTES: Sealed submittals for this contract must be received before Wednesday, October 5, 2022 at 1:00 pm at the Office of the County Clerk, 105 South 5th St – Suite 104, Oregon, IL 61061. Cost proposals and associated paperwork must be submitted in a sealed envelope clearly marked “Ogle County Correctional Center Demolition Proposal”. Questions regarding this RFP shall be submitted in writing to Jeremy Ciesiel via email at highway@oglecountyil.gov. No oral clarifications or amendments to this RFP shall be binding on the county. Any amendments, addenda or modifications shall be sent in writing to all firms that have registered as a plan holder. A bid security in an amount equal to not less than five percent (5%) of the total base bid shall be submitted with each bid. Bids may be held by Ogle County for a period not to exceed forty- five (45) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of bidders, prior to awarding the Contract. Ogle County reserves the right to reject any or all bids or to waive any informalities in the bidding and also reserves the right to reject any non-responsive bid and/or non-responsible bid. GENERAL: a) To be considered, bids must be made in accordance with these Instructions to Bidders. 2. INTENT: a) It is the intent of this bid request to obtain an offer to perform the work to complete the demolition of the Ogle County Correctional Center (Old Jail) located at 107 South 5th Street in Oregon, IL, for a stipulated sum contract, in accordance with the contract documents. 3. DOCUMENTS: a) Prime bidders may obtain bid documents from the Ogle County Courthouse during regular business hours or download the documents from the website: www.oglecounty.org. 4. BID SECURITY: a) Bid security shall be a bid bond issued by a surety licensed in the State of Illinois or cashier’s check. b) Bid security shall be made payable to Ogle County in the amount of five percent (5%) of the total bid amount. c) The successful bidder’s security will be retained until the Agreement has been signed and the Performance Security is in place. Ogle County reserves the right to retain the bid security of the next lowest bidder until a Contract has been signed or until sixty (60) days following the bid opening, whichever is shorter. All other bid security shall be returned as soon as practicable. d) Should any bidder refuse to enter into and/or perform a Contract, under the terms of the bidding instrument, the County will retain the bid security without prejudice against any other damages or remedies the County may pursue. 9. SUBMITTAL: a) Submit bid and bid security in a sealed envelope. Failure to provide required security and bid documents may result in rejection of the bid. b) Envelope shall be clearly identified with the project name and the name and address of the bidder on the face of the sealed envelope. c) Bids must be received at the office of the County Clerk, 105 South 5th St – Suite 104, Oregon, IL 61061 no later than 1:00 P.M. (local time) on Wednesday, October 5, 2022. Bids will be publicly opened and no other bids will be accepted. 10. WITHDRAWAL: a) Bids may be withdrawn at any time before the bid opening but may not be resubmitted. County may, at its sole discretion, provide exception if bid was turned in prior to issuance of Addenda or other conditions merit consideration. b) Bids may not be modified after submittal. c) Bids may not be withdrawn or modified after bid opening unless Award of Contract has been delayed by more than ninety (90) days. 11. ACCEPTANCE/REJECTION: a) Ogle County reserves the right to accept or reject any or all bids, waive any technicalities or informalities in the bidding, postpone the bid opening and to reject bids and/or award the Contract as determined to be in the best interest of Ogle County. 12. BIDDER QULIFICATIONS: a) To demonstrate qualification for performing the Work of this Contract, Bidders may be requested to submit written evidence of financial position, previous experience, current commitments and license to perform work during the bid review process, following the submittal of bids, conducted by owner. 13. BIDDER AWARD: a) For the purpose of preliminary consideration, the “Apparent Low Bidder” will be determined by bids for specified work. It is the intent of Ogle County to have the demolition completed as quickly as possible. This includes the backfilling of the excavation. Given the time of year, it is understood that it may not be possible to complete final grading and seeding until Spring 2023. Final grading and seeding shall be completed no later than April 15, 2023. c) County may accept or reject any or all substitutions. 14. SUBSTITUTIONS: a) Bids shall be based upon the articles and materials named in the specifications. Substitutions may be made only under the following condition: i) At the time bids are received, Prime Bidders may submit on a separate sheet enclosed with the bid form, a list of proposed substitutions which they are willing to guarantee, stating the additions to or deductions from the bid price in case they are allowed. Technical data and complete descriptions shall be submitted. 15. METHOD OF BIDDING: a) Proposals shall include all work necessary to perform the work described and set forth in the specifications. Bids shall be listed as a lump sum and shall be based on all costs. 16. AWARD: a) Award of the successful bid shall be accomplished by acceptance of the bid by the Ogle County Board and the execution of a contract with the successful bidder. Request for Proposal Demolition of Ogle County Correctional Center 107 South 5th Street Oregon, Illinois 17 | P a g e GENERAL CONDITIONS PROJECT ADDRESS – 107 South 5th Street, Oregon, IL 61061 There were identified asbestos containing building materials located as a result of an asbestos inspection. The asbestos report is attached. Asbestos was abated under a separate contract. Abatement paperwork can be found in Appendix B & C. Work will be performed adjacent to the open and active Ogle County Courthouse. Work shall not interfere with the operations at this facility. The contractor will be permitted to close the eastern parking lot entrance off of Jefferson Street as well as the nine (9) parking stalls accessible from this entrance. The remainder of the parking lot west and northwest of the of the Correctional Center shall remain open. Please see Section K in Article 1 for specifics. This project will require the demolition of the Ogle County Correctional Center. After demolition, the area needs to be graded to match the existing grade with 4-6” of topsoil, seeded and mulched as specified below. The general specifications are located below. Applicable parts of demolition requirements are included herein. The contract shall be subject to the provisions of the Prevailing Wage Act (820 ILCS 130/1 et seq.) to the extent required by law. ARTICLE 1 GENERAL DEMOLITION SPECIFICATIONS A) MOBILIZATION 1. Once a Notice to Proceed is issued, any and all value of the building materials or items on the property is under the direction and control of the Contractor, unless otherwise noted herein. B) IEPA NOTICE OF DEMOLITION 1. Contractor shall file State of Illinois Demolition Notification Form (see Appendix A) and pay associated fee. a) In April 2022 an Asbestos Inspection was performed. The Inspection Report can be found in Appendix B. b) In May 2022 Asbestos Abatement was performed. All identified asbestos materials were removed during the abatement. The abatement information can be found in Appendix C. C) GENERAL UTILITIES 1. Ogle County is arranging for the private utility disconnections. a) Nicor is completely disconnected. b) Comcast is working on relocating their line away from the demolition site. c) County is currently working on disconnecting the secondary line between the ComEd transformer and the Correctional Center. 2. ComEd has a live transformer near the northwest corner of the Ogle County Correctional Center that still powers the Ogle County Courthouse. There are also two slab mounted generators in the Request for Proposal Demolition of Ogle County Correctional Center 107 South 5th Street Oregon, Illinois 18 | P a g e same area. While these items have been disconnected from the Ogle County Correctional Center, these are active items that are to remain and not be damaged during the demolition of the Correctional Center. D) WATER TERMINATIONS 1. The watermain comes out of the south wall of the jail. Ogle County is arranging for the disconnection of the service from the City of Oregon main. Following the disconnection of the line from the City main, the Contractor shall disconnect the service line from the building prior to demolition. E) SANITARY AND STORM SEWER 1. The Ogle County Correctional Center and the Ogle County Courthouse share a sanitary and storm sewer system. These systems are accessible thought the manholes north, west and east of the Correctional Center. 2. Existing sewer lines run beneath the slab-on-grade sections of the Correctional Center as shown in Appendix E. These lines are to be left intact during demolition. Any damaged piping or manholes shall be repaired prior to backfilling. 3. The sanitary manhole located in concrete slab near southwest corner of the Correctional Center shall be adjusted to more closely match final grade after demolition. F) DEMOLITION AND SITE CLEARANCE 1. Contractor shall install a temporary chain-link fence around the site for public protection during demolition. Contractor shall be allowed to close the eastern parking lot access off of Jefferson St and close the 9 parking stalls in the east part of the lot. Approximate limits of the fence can be found on the attached site plan on Page 10. 2. No wall or part thereof shall be permitted to fall outwardly from any building except through chutes or by other controlled means or methods which will insure safety and minimize dust, noise and/or other nuisance. G) DUST CONTROL 1. The Contractor shall implement a dust and vapor control plan. Contractor shall execute work by methods to minimize generation of dust from demolition activities. Fugitive dust control strategies shall be composed of a balance of available dust mitigation techniques applied on an as needed basis by construction site supervision to: prevent dust from exiting the Work zone; prevent visible emissions from exceeding air quality regulations; and prevent public nuisance. 2. Dust control shall include: wind breaks and barriers; frequent water applications; control of vehicle access; vehicle speed restrictions; covering of piles; use of gravel at site exit points to remove caked on dirt from tires and tracks; cleaning of equipment at the end of each work day and prior to site removal; sweeping of public thoroughfares, and work stoppage as necessary to maintain compliance with dust control requirements. a) Prevent wind erosion and air pollution by wetting down, or applying other approved dust control measures to the Work Site. Contractor will control the generation of dust, which could violate State and local air pollution control standards or damage onsite/offsite facilities. H) FOUNDATION AND MASONRY BLOCK 1. Building foundation walls, including cross-walls, partitions, columns, piers, areaways, stairwells, chimneys, porches, steps and platforms, interior or exterior dock walls and floor, machinery and equipment foundations and all similar structures and parts shall be completely demolished and removed from the site. Fills of earth, sand, gravel, crushed rock, cinders or similar materials under floors elevated above outside ground level shall be removed from the site to a depth of 2 feet below final grade. I) CONCRETE SLABS AND FLOORS 1. Concrete or brick floors of basements, or of areaways, stairwells or depressed structures shall be completely removed from the site. 2. Floors of exterior stairwells, areaways or depressed structures shall be completely removed from the site. 3. Concrete slabs on ground, including floors of basementless buildings, entrance slabs, garage floors, and similar exterior slabs whether of concrete, masonry, rock or stone shall be completely removed from the site. J) OGLE COUNTY COURTHOUSE 1. Bidders are hereby notified that the adjacent Ogle County Courthouse at the north end of the Correctional Center will remain operational throughout the durations of the Project. Contractor shall coordinate all work and minimize disruptions to operations. Furthermore, this structure is not to be damaged during demolition. a) A doorway exists between the stairwell of the Ogle County Correctional Center and the lower level of the Ogle County Courthouse. The door is set in the masonry wall of the Correctional Center. This door is to be removed and the opening filled by the demolition contractor with IDOT Class SI Concrete in a manner consistent with the details contained in Appendix E. b) Demolition operations shall be coordinated in such a manner that the basement of the Courthouse is not left exposed. If the contractor is unable to seal off the opening the same day it is exposed, the opening shall be shored up and otherwise protected from the weather until concrete can be placed. c) Conduit shall be placed within the doorway in a manner consistent with the detail in Appendix E for future electrical connections. K) SANITARY SEWERS, WATERMAIN AND BUILDING DRAINS 1. Sanitary sewers, drains, and similar facilities serving the Correctional Center building shall be capped and sealed to the satisfaction of the City of Oregon before general demolition of that building is begun. The method of capping shall not interfere with the active lines serving the Ogle County Courthouse. Partial removal of sufficient portions of a structure shall be performed where necessary to permit sealing of sanitary or drainage systems in advance of general demolition of that structure, except where such local removal would create a hazard to safety. 2. Soil pipe and stacks shall be cut off neatly and shall be plugged with a suitable material which will enable the solid placing of not less than eight inches (8") of good, well-tamped mortar in the open end of the pipe. If open sewer pipe of clay, asbestos, or fiber are unearthed or exposed, it shall be plugged in the manner specified for soil pipes. 3. The exposed end of any piping forming a part of a sanitary system shall not be left in such a condition or position that it might subsequently be broken below the cap or plug. The contractor shall install such fill or earth or concrete as is necessary to protect such piping against future loosening or breakage. L) TREES AND VEGETATION 1. Trees on the property should be saved. 2. Trees seriously damaged by the contractor shall, if ordered, be properly trimmed or cut down flush with the ground and disposed of without additional cost to Ogle County. 3. Any trees severely damaged or killed due to operations of the contractor shall be replaced with trees of the size and type specified by the Ogle County Board. Filling of all basements and large excavations and filling of other depressed areas is required and shall be to final grade. (See Section P for details on fill material) N) DISPOSAL 1. Disposal of trash and waste building materials shall be at a point outside of the project. All material shall be disposed of by the contractor at locations provided by him; in no case shall discarded materials be left in piles on the site. 2. All rubbish and debris found on the demolition area at the start of the work as well as that resulting from the demolition activities, or deposited on the site by others during the duration of the contract, shall be removed and disposed of in an IEPA licensed land fill or other legal and acceptable site. 3. The manner of disposal of such materials shall be subject to the approval of the project manager and shall conform to all local, State and Federal laws. a) The contractor shall obtain and file with the project manager written permission from the property owner for the use of private property for this purpose, subject to all local, State and Federal laws. O) RECAPTURE OF FREON 1. It is the responsibility of the Contractor to recapture Freon according to EPA standards, when air conditioning is in a building which is to be demolished. P) FILL MATERIALS 1. Where demolition takes place, fill affected area with fill materials Type A or B to a depth of 24” below finished grade; the next 12” shall be of fill materials Type C or D; The remaining 12” shall be subsoil covered with at least 4” of topsoil. 2. Type A - Select Granular Material: Coarse stone: Pit run, Angular, Crushed, natural stone; free of shale, clay, friable material, sand, debris. 3. Type B - Pea Gravel: Natural stone; free of clay, shale, organic matter. a) Minimum Size: 1/4 inch. b) Maximum Size: 5/8 inch. 4. Type C - Sand: Natural river or bank sand; free of silt, clay, loam, friable or soluble materials, and organic matter. 5. Type D - Subsoil: Free of lumps larger than 3 inches, rocks larger than 2 inches, and debris. Q) GRASS SEED 1. Grass seed will be in the following ratio: 50% Ryegrass, 30% Fine Fescue, 20% Kentucky Bluegrass. R) ACCESSORIES 1. Agricultural Mulch: Peat moss, well-rotted manure, or straw. 2. Fiber Roll: Fiber rolls consist of straw, flax or similar materials inserted into a tubular net. 3. Mulching Material: Composted, shredded hardwood bark, dark brown in color. S) CARE OF WORK 1. The CONTRACTOR shall be responsible for all damages to person or property that occur as a result of his fault or negligence in connection with the prosecution of the work and shall be responsible for the proper care and protection of all materials delivered and work performed until Request for Proposal Demolition of Ogle County Correctional Center 107 South 5th Street Oregon, Illinois 21 | P a g e completion and final acceptance, whether or not the same has been covered in whole or in part by payments made by the OWNER. 2. The CONTRACTOR shall provide sufficient competent watchmen, both day and night, including Saturdays, Sundays, and holidays, as may be necessary from the time the work is commenced until final completion and acceptance. 3. In an emergency affecting the safety of life, limb or property, including adjoining property, the CONTRACTOR, without special instructions or authorization from the OWNER, is authorized to act at his discretion to prevent such threatened loss or injury, and he shall so act. He shall likewise act if instructed to do so by the OWNER. The OWNER will determine any compensation claimed by the CONTRACTOR on account of such emergency work. 4. The CONTRACTOR shall avoid damage as a result of his operations to existing sidewalks, streets, curbs and pavements, utilities (except those which are to be replaced or removed), adjoining property, etc., and he shall, at his own expense, completely repair the damage thereto caused by his operations. This does not include the pavements and sidewalks on Ogle County property within the work zone as indicated on the Site Plan on Page 10. T) ACCIDENT PREVENTION 1. No laborer or mechanic employed in the performance of this Contract shall be required to work in surroundings or under working conditions, which are unsanitary, hazardous, or dangerous to his health or safety as determined under construction safety and health standards promulgated by the Secretary of Labor. 2. The CONTRACTOR shall exercise proper precaution at all times for the protection of persons and property and shall be responsible for all damages to persons or property, either on or off the site, which occur as a result of his prosecution of the work. The safety provisions of applicable laws and building and construction codes shall be observed and the CONTRACTOR shall take or cause to be taken such additional safety and health measures as the OWNER may determine to be reasonably necessary. Machinery, equipment and all hazards shall be guarded in accordance with the safety provisions of the “Manual of Accident Prevention in Construction” published by the Associated General Contractors of America, Inc., to the extent that such provisions are not in conflict with applicable laws. 3. The CONTRACTOR shall maintain an accurate record of all cases of death, occupational disease, or injury requiring medical attention or causing loss of time from work, arising out of and in the course of employment on work under the Contract. The CONTRACTOR shall promptly furnish the OWNER with reports concerning these matters. 4. The CONTRACTOR shall indemnify and save harmless the OWNER from any claims for damages resulting from property damage, personal injury and/or death suffered or alleged to have been suffered by any person as a result of any work conducted under this contract. ARTICLE 2 INSURANCE A) CONTRACTOR’S LIABILITY INSURANCE 1. At the Contractor's expense, the Contractor shall secure and maintain in effect throughout the duration of this contract, insurance of the following kinds and limits. The Contractor shall furnish Certificates of Insurance to the County before commencing performance or within ten (10) days after the execution of the contract, which ever date is reached first. All insurance policies shall be written with insurance companies licensed to do business in the State of Illinois and having a rating of not less than A VI, according to the latest edition of the A.M. Best Company. Comprehensive General Liability: a) Coverage to include Premise/Operations, Products/Completed Operations, Independent Contractors, Broad Form Property Damage, Contractual and Personal Injury. (i) Limits: General Aggregate $2,000,000.00 Products/Completed Aggregate $1,000,000.00 Each Occurrence $1,000,000.00 Personal Injury $1,000,000.00 (ii) Exclusions relating to the Explosion, Collapse and Underground hazards shall be deleted. (v) Cover all claims arising out of the Contractor's operations or premises, Subcontractor's operations or premises, anyone directly or indirectly employed by the Contractor or Subcontractor, and the Contractor's obligations under indemnifications under this Contract. b) Owners & Contractors Protection: (i) Limits Bodily Injury Annual Aggregate $1,000,000.00 Each Occurrence $1,000,000.00 Property Damage: Annual Aggregate $1,000,000.00 Each Occurrence $1,000,000.00 c) Workers Compensation: (i) Shall be in accordance with the provisions of the laws of the State of Illinois, including occupational disease provisions, for all employees at the site of the project, and in case work is sublet, the Contractor shall require each Subcontractor similarly to provide Workers Compensation Insurance. In case employees engaged in hazardous work under this contract at the site of the project are not protected under Workers Compensation statute, the Contractor shall provide, and shall cause each Subcontractor to provide, adequate and suitable insurance for the protection of employees not otherwise provided. d) Comprehensive Automobile Liability: (i) Coverage to include all Owned, Hired, Non-owned vehicles, and/or trailers and (ii) Limits: Combined Single Limit $1,000,000.00 e) Umbrella: (i) Limits: Aggregate $1,000,000.00 (ii) Cover all claims arising out of the Contractor's operations or premises, Subcontractor's operations or premises, anyone directly or indirectly employed by the Contractor or Subcontractor, and the Contractor's obligations under indemnifications under this Contract. 3. Ogle County, its officers and employees shall be named as additional insureds on a primary and non-contributory basis under all required policies of insurance. An endorsement from the insurance carrier confirming Ogle County is additional insured, including the provision of legal representation in the defense of claims asserted against the County. a) The policy shall include a provision preventing cancellation of the insurance policy unless fifteen (15) days prior written notice is given to the County. This provision shall also be stated on each Certificate of Insurance as "Should any of the above described policies be canceled before the expiration date, the issuing company will mail 15 days written notice to the certificate holder named to the left". 5. The Contractor shall require any and all subcontractors performing work under this Agreement to also maintain such minimum insurance coverage. 6. The Contractor understands and agrees that any bond or insurance required by this contract or otherwise provided by Contractor, shall in no way limit the responsibility to indemnify, keep and save harmless, and defend the County as herein provided. 7. Nothing contained herein shall be construed as prohibiting the County, its officers, agents, or its employees, from defending through the selection and use of their own agents, attorneys, and experts, any claims, actions, or suits brought against them. The Contractor shall be liable for the costs, fees, and expense incurred in the defense of any such claims, actions, or suits. 8. Neither the Contractor nor any subcontractor shall commence work under this Agreement until the insurance requirements of this Article have been met and a certificate of insurance from the Contractor and any subcontractors evidencing the required coverage has been provided to the County. B) PERFORMANCE SECURITY 1. The Contractor must provide contract performance and payment security based upon 100% of the contract total. This security must be in the form of a surety bond licensed in Illinois with a Best's rating of no less than A-.THE ORIGINAL FORM MUST BE PROVIDED. FACSIMILE, ELECTRONIC, OR PHOTOCOPIES ARE NOT ACCEPTABLE. C) CERCLA INDEMNIFICATION 1. The Contractor shall, to the maximum extent permitted by law, indemnify, defend, and hold harmless the County, its officers, employees, agents, and attorneys from and against any and all liability, including without limitation, costs of response, removal, remediation, investigation, property damage, personal injury, damage to natural resources, health assessments, health settlements, attorneys' fees, and other related transaction costs arising under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980, 42 U.S.C.A. Sec. 9601, et seq., as amended, and all other applicable statutes, regulations, ordinances, and under common law for any release or threatened release of the waste material collected by the Contractor, both before and after its disposal. ARTICLE 3 CONTRACT TIME A) CONTRACT TIME 1. Ogle County will issue a Notice to Proceed to the Selected Contractor. 2. It is the intent of this Project to have the building demolished and the excavation substantially backfilled as soon as possible. 3. Final site grading and site seeding shall be completed by April 15, 2023, subject to unavoidable delay. Request for Proposal Demolition of Ogle County Correctional Center 107 South 5th Street Oregon, Illinois 24 | P a g e a) “Unavoidable Delay” is a delay resulting from (a) city-wide or industry-wide strikes or lock- outs, (b) Acts of God, (c) inability to obtain labor or materials due to governmental restriction, (d) enemy action, (e) civil commotion, (f) fire, (g) unavoidable casualty, (h) work stoppages caused by illegal acts of third parties. b) Unavoidable delay does not include (a) changes in prices, (b) Contractor's insolvency, financial condition, or any other monetary problem, (c) the insolvency, financial condition, or refusal to perform by any contractor, subcontractor, or professional retained by Contractor (including but not limited to engineers, architects, or attorneys) or (d) the administrative delay of any governmental or nongovernmental agency, commission, or board. ARTICLE 4 PAYMENTS AND COMPLETION A) PRIOR TO PAYMENT REQUIREMENTS 1. Submit certified copies of payroll as required. 2. Submit copy of 10 Day EPA notification B) APPLICATION FOR PAYMENT 1. Submit each Application for Payment on form acceptable to Owner. 2. Submit updated demolition schedule with each Application for Payment showing percent complete. 3. Payment Period: a) Payment of up to 6% of the original contract amount will allowed upon request for mobilization after Notice to Proceed is issued. b) Subsequent applications shall be submitted at regular intervals, not less than every thirty (30) days. ARTICLE 5 TERMINATION OF THE CONTRACT A) TERMINATION BY THE CONTRACTOR 1. If the Work is stopped for a period of thirty days under an order of any court or other public authority having jurisdiction, through no fault of the Contractor, or if the Work should be stopped because the owner has not made Payment thereon as provided in paragraph 4-B, then the Contractor may upon twenty-one (21) days written notice (from postmark) to the County, terminate the Agreement. B) TERMINATION BY THE OWNER 1. In the event of any breach of this Agreement by the Contractor, the Owner may, at its option, serve the Contractor with a written seven (7) day notice (from postmark) to complete the work, after which the Owner may take possession of all materials at the work site, engage the service of another contractor to complete the work, and deduct the cost of such completion from any amount due the Contractor hereunder. If the payments then or thereafter due the Contractor are not sufficient to cover such amount, the Contractor shall pay the difference to the Owner. In the event that the Contractor, as a result of litigation, is adjudged to have breached this Agreement, the Contractor shall pay, in addition to any damages awarded to the Owner, the Owner's reasonable attorney's fees resulting from such litigation.
