The use of unapproved devices and services may result in potential costs and damages for the Government.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Stryker is the sole manufacturer, servicer, trainer, and parts provider for the Stryker Neptune. There are no other sources capable of fulfilling this requirement.Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the government is deemed fair and reasonable based off current contract pricing (36C25722C0041). Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research included communications with the vendor, reviewing other contracting activity on sam.gov, discussing with the clinical users, and gathering information on service history/availability from the Information Systems Biomedical Equipment Support Specialist who is responsible for this equipment. The vendor has also issued a Proprietary Letter which is included in this packet.Any Other Facts Supporting the Use of Other than Full and Open Competition: In the event of a patient injury related to the use of unapproved devices and service, Stryker will consider our use of unapproved devices and service as a violation of the conditions of indemnification. The use of unapproved devices and services may lead to Veteran injury and Government liability.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Stryker InstrumentsA Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Going forward, robust market research will be conducted for procurement requests to determine socio-economic make-up and potential competition opportunities within the marketplace.
