Housing Finance Authority (“CHFA”) requests written qualifications from not-for-profit or for-profit law firms or other legal service providers with offices in the State of Connecticut that have 10+ years’ experience representing homeowners described below in the areas of foreclosure, workouts, bankruptcy and eviction proceedings. CHFA will not reimburse for any expenses incurred in connection with this Request for Qualifications (“RFQ”) including, but not limited to, the cost of preparing the initial response and any additional information requested or travel expenses relating to any oral presentation. Please be advised that responses will be considered property of CHFA, are matters of public record, and may be disclosed by CHFA after the awarding of a contract. OVERVIEW CHFA, a body politic and corporate constituting a public instrumentality and political subdivision of the State of Connecticut (“State"”), was created in 1969 and operates pursuant to Chapter 134 of the Connecticut
General Statutes, as amended. CHFA’s purpose is to help alleviate the shortage of affordable housing for low-income and moderate-income families and persons in Connecticut by providing single family mortgages, financing for rental housing, and mortgages for the purchase, development, and construction of housing. The American Rescue Plan Act of 2021 (Public Law No: 117-2) established a Homeowner Assistance Fund with an appropriation to the U.S. Treasury Department to provide funding to mitigate financial hardships associated with the coronavirus pandemic (“Federal Program.”) CHFA and the Connecticut Department of Housing, the responsible entities for distributing Federal Program funding in Connecticut, established the MyHomeCT Program, to provide funding in the State for the purpose of preventing homeownership delinquencies, mortgage defaults, and foreclosures. For additional information about MyHomeCT, please reference CHFA’s website at www.chfa.org/myhomect. THE RESPONSE DATE HAS BEEN EXTENDED TO MAY 2, 2022 http://www.chfa.org/ http://www.chfa.org/myhomect - 2 - SCOPE OF SERVICES CHFA, in connection with the MyHomeCT Program, is seeking qualified legal service providers to provide legal advice and representation to Connecticut homeowners (“Homeowners”) regarding their legal rights and options. CHFA will make a determination as to which Homeowners may be eligible for Legal Services with respect to pre-foreclosure matters; foreclosure actions; tax sales; bankruptcy options; loan and/or lien workouts; and eviction actions (“Legal Services”). Respondents may specify their areas of expertise and failure to practice all Legal Services specified will not disqualify a respondents. Respondents must have satisfactory capacity and/or staff qualified to perform the following Legal Services for Homeowners: a) Preventing mortgage foreclosures: i. Exploring loan modification options, debt negotiation or, responsible refinancing options; ii. Advising Homeowners regarding Bankruptcy options including, but not limited to, the ramifications or filing a Chapter 13 or 7 bankruptcy when appropriate to preserve the Homeowner(s)’ housing; iii. Reviewing foreclosure alternatives including deed in lieu of foreclosure, short sale or home sale options. In the event of a foreclosure judgment, discussing the eviction process or alternatives and potential post-foreclosure deficiencies. b) Preventing tax sales or foreclosures by municipalities, water and sewer providers or by homeowners’ and/or condominium associations: i. Negotiating with municipalities to cure, defer or negotiate tax, water or sewer arrearages to allow Homeowners to retain their homes; ii. Negotiating with homeowners’ and/or condominium associations to cure, defer or negotiate
