Indigent Legal Services, “County” is soliciting proposals from qualified firms or attorneys “Proposer / Contractor / Attorney” to provide to provide conflict legal defense services to indigent parents or guardians who cannot be served by the County’s primary contract legal firm in the matters over whom the Third District Juvenile Court of Salt Lake County asserts jurisdiction in abuse, neglect and dependency proceedings and/or to whom the Court appoints counsel consistent with Senate Bill 203 (2018 General Session). The County wishes to contract with six attorneys or firms to handle cases when the primary firm has a conflict which would violate the Professional Rules of Conduct or applicable statutes or caselaw. The County is required by state law to provide legal representation, at every stage of Court proceedings, for all indigent parents or guardians in abuse, neglect, and dependency proceedings in the Third District Court to whom counsel has been appointed by the Court consistent with the requirements of Utah Code: Any action initiated by the state or a political subdivision of the state under Chapter 78A-6, Parts 3, 5, or 10, or under section 78A-6-1101, UTAH CODE ANN. (2018), including all proceedings directly related to the petition or motion filed by the state, or a political subdivision of the state, if the parent or legal guardian requests an attorney and is found by the court to be indigent; and Any action initiated by a private party under chapter 78A-6, Part 5, UTAH CODE ANN. (2018) or termination of parental rights under section 78A-6-112, UTAH CODE ANN. (2018), if the parent or legal guardian: a) qualifies as indigent under section 77-32-202, UTAH CODE ANN. (2018); and b) does not, after being fully advised of the right to counsel, knowingly, intelligently, and voluntarily waive the right to counsel. A primary law firm provides most of the services related to this statutory requirement. In the occurrence that the primary firm has a conflict that would violate the Professional Rules of Conduct or applicable statutes or caselaw, the County will contract with six attorneys or firms to provide legal representation for indigent parents or guardians. The awarded Proposer will represent eligible indigent parents or guardians in original cases pursuant to Salt Lake County’s legal responsibility. Beginning January 1, 2025, new cases will be referred to the Proposer by the Court; the Proposer will assume responsibility for cases pending for which existing contractor(s) had responsibility prior to December 31, 2024. The average estimated number of hours spent on this work in 2023 was 1,558 hours per provider. The County shall provide Attorney with an Excel file as a template to collect services data. Attorney shall submit the file to County along with the payment request monthly. Services data may include but shall not be limited to the following: case number, client name, appointment and close date, Judge’s name, activities, and hours. The content and format of the template may be subject to changes from time to time due to Salt Lake County’s reporting needs. Additionally, County may provide Title IV-E funds to the services in the areas set forth below to enhance County’s indigent parental defense services system. County, at its sole discretion, reserves the right to revise or cancel these additional services when funding is no longer sufficient or available: 1. Transcript costs for appellate cases shall be reimbursed by County through Title IV-E funds. Attorney shall notify County/Human Services Department Fiscal Administrator within 2 days of ordering transcript in a written email. Attorney will remit the bill to the County for reimbursement or payment, by including it in the monthly payment request. 2. Social services, from a roster of pre-approved social service professionals, will be made available for Description Attorney up to 40 hours per month. Minimum Requirements All attorneys/firms who propose to perform these services must have certification of good standing from the Utah Bar Association. The Proposer must have relevant experience of similar legal representation in abuse, neglect, and dependency cases or related fields; must be able to maintain records and accounts necessary to document defense activities and to assure proper accounting for all funds paid to the attorney. In addition, attorneys are expected to participate in training specific to parental defense, child welfare, mental health, and substance use issues to remain current with best practices in the field.
