Notice of Intent to Sole Source / Sources Sought to Oxford Instruments America for On-Site Annual Maintenance Agreement.In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the U.S. Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to Oxford Instruments America, Inc. for an annual comprehensive on-site maintenance agreement renewal for NETL’s AZTEC micsF+/x-stream2//X-Max80.  This requirement is for a base year (09/14/2021 – 09/13/2022) plus up to four, one-year option periods through 09/13/2026.  This is considered a sole source to Oxford Instruments because, to the best of the NETL’s knowledge, based on market research conducted Oxford Instruments is the confirmed sole source service provider for this maintenance.  Oxford Instruments is currently the only service provider in the United States for the AZTEC micsF+/x-stream2//X-Max80.  Oxford Instruments does
not train, authorize, or support third party service organizations in repair or maintenance of Oxford instruments.  This is an on-site maintenance agreement needed to ensure continued use of the equipment and covers replacement units and upgrades of the system necessary to keep the unit operable. Oxfords Instruments (the original equipment manufacturer) must provide the maintenance service (done by their trained staff) and replacement parts to guarantee performance to the original specifications of the instrument.  Any repairs performed by third party service providers void all warranty and maintenance agreement obligations of Oxford Instruments.  No known potential alternate sources exist which could satisfy NETL's requirement.This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 4:00 PM EDT on July 22, 2021.  Responses must be submitted in writing to the purchasing agent, Lora Stumpf, via email at stumpf@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
