Quantities listed in this invitation to bid are estimated, for figuring purposes only. STORAGE: Contractor must maintain on hand at all times, ready for immediate delivery, not less than 10,000 gallons of #2D regular diesel fuel. 11. SAMPLES: Samples for analysis as taken by the County shall be accepted by the contractor as proper and the analysis as made by the County shall be final. 12. QUALITY: Contractor will be required to assume full responsibility for the quality of oil furnished. If any oil is supplied which proves un- satisfactory in use, or an analysis shows it does not come within the requirements of the specifications, contractor will be required to remove the remaining oil and supply oil of a proper quality. In default thereof, the County may purchase same in the open market at the contractor=s expense, and deduction in price made for consumed oil. 13. CANCELLATION: Contract entered into under the terms of these specifications may be canceled by the County, if after analysis and practical test of such duration as may be decided by the County, it is determined that oil is not being supplied in accordance with the specifications, or if through fault of the contractor, deliveries are not made when ordered by the County, causing a shortage of oil to the County. If contract is canceled, the County may purchase proper oil in the open market and any additional cost to the County through such action will be charged to the contractor. 14. THE COUNTY MAY, AT ITS SOLE OPTION, ADD ADDITIONAL LOCATIONS AS REQUIRED, AT PRICE LEVELS CONSISTENT WITH THE PRICES QUOTED HEREIN. 15. Quantities listed are estimates only. 16. It is the responsibility of the successful vendor to perform proper clean up of any petroleum product which is spilled as a result of tank refueling, including spillage to the ground’s surface and/or spillage into fuel tank “catch basins” or other secondary containment devices. 17. The list of generator locations have been added to this bid due to any power or snow emergencies where generators must be utilized, deliveries have to be made to these designated locations.
