Request for Information about prospective Consulting Services for Resettlement Action Plan (RAP) Implementation and Technical Supervision Services for Electricity Transmission Project: Transmission Lines and Substation ActivitiesThe Millennium Challenge Corporation (“MCC”) and the Government of Nepal (the “Government” or “GoN”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Nepal (the “Compact”) in the amount of approximately USD 500 million (“MCC Funding”). The Government is acting through the Millennium Challenge Account-Nepal (the “MCA-Nepal”) for the implementation of the projects funded under the Compact.The goal of the Compact is to reduce poverty through economic growth. The Compact program includes two projects: (i) construction of about 300 kilometers of 400 kV electricity transmission lines, three substations, and technical assistance for the power sector; and (ii)
technical assistance to improve the road maintenance regime and road maintenance works on about 300 kilometers of the strategic road network. The program would include the procurement of contractors and consultants for design, construction and supervision of electricity lines and substations, road maintenance works, including a variety of technical services, equipment and construction works in different geographic locations within Nepal. The Compact can be accessed at http://mcanp.org/wp-content/uploads/2019/04/Millennium_Challenge_Compact.pdf.Summary of Expected Scope of WorkMCA-Nepal is currently at the final stage of completion of the design of the Electricity Transmission Project and may need to hire Consultants for the provision of the following services: (i) Resettlement Action Plan Implementation (RAP Implementation); and (ii) Construction Supervision of Electricity Transmission Project (ETP) i.e. Transmission Lines and Substations in Nepal. MCA-Nepal through this Request for Information would like to receive information from prospective Consultants to provide: a) only RAP Implementation services b) only Construction Supervision Services and c) both RAP Implementation and Construction Supervision Services together; in case MCA-Nepal decides to launch a procurement process for hiring these services.Resettlement Action Plan Implementation (RAP Implementation)RAP Implementation represents the Consultant’s work implementing the approved RAP(s) for the Electricity Transmission Project (ETP). The scope of work will involve the following:Assisting MCA-Nepal in making payments, through the MCA-Nepal (Fiscal Agent (FA) or any other agency assigned by MCA-Nepal, to Project Affected Persons (PAPs) including the provision of titles to land as required;Keeping records of compensation payments accessible in a data base, with evidence of delivery in the form of photographs or video and signed receipts from recipients;Facilitating PAPs in receiving the approved compensation (whether in-kind or cash) and understanding their entitlement to benefits;Ensuring that the land is cleared prior to construction;Overseeing any required development of resettlement sites and structures, in coordination with MCA-Nepal and any required works contractors; andReporting on RAP completion including conducting a Resettlement Completion Audit.It is expected that the prospective Consultant has (i) experience in preparing and implementing Resettlement Action Plans compliant with International Finance Corporation - IFC PS 5 or similar international standards for linear power projects of similar scale and (ii) experience in the implementation of at least one (1) RAP for a new 100 kilometers overhead line in the last 5 years.Construction Supervision for Transmission Lines and Substations Activities (Construction Supervision)Following the procurement of works contractors to implement the transmission line and substations works program under the ETP, MCA-Nepal will require a Consultant to provide construction supervision services. The Consultant will serve as the Engineer under an International Federation of Consulting Engineers (FIDIC) Design-Build (Yellow Book) contract with MCA-Nepal as the Employer. The Consultant shall be responsible for providing technical supervision of contractors implementing final design and construction, ensuring that work is completed according to technically sound methodologies and technical specifications using materials and equipment of adequate standards and within the hard cost and time constraints required under the Compact. The Consultant shall ensure appropriate quality assurance and control for all construction activities.It is expected that the prospective Consultants has (i) experience in technical supervision of works and contractors including review and approval of final designs and supervision of construction, including all environmental health & safety, and resettlement requirements, with experience with FIDIC contracts preferred, and (ii) executed at least two (2) construction supervision projects with a similar scope during the last ten (10) years in a developing country context with an increasing preference for experience in the following order: (a) South Asian Association for Regional Cooperation (SAARC) countries, (b) Indian sub-continent, and (c) Nepal.The prospective Consultants are requested to provide below mentioned information so that MCA-Nepal can decide further about the procurement process based on available options.
