Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ Reference Number POA-2020-00406, Snake River, has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below and shown on the enclosed project figures/drawings. Robert.b.murray@combase.netProject Name: Snake River Kerr Landing Strip and PadLocation: The proposed activity is located within Section 5 & 8, T. 11 S., R. 34 W.; Latitude 64.555750° N., Longitude -165.513286° W.; in Nome, Alaska.Purpose: The applicant’s stated purpose is to provide a stable pad and access to a home site in the Snake River Subdivision. Project Description: The applicant has proposed to discharge 2,270 cubic yards of fill into 0.703-acres of palustrine wetlands for the construction of an 825-foot-long 25-foot-wide access road and a 100 by 100-foot housing pad. Fill material will be sourced from dredge tailing stacked approximately 2 ¾ miles east of the subdivision. The eastern edge of the building pad will be 125 feet from the Snake River, maintaining a buffer from the river.
After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws.
