Labor Relations Professional Services Project Description: The City University of New York (“University” or “CUNY”) is seeking to enter into a contract (“Contract” or “Agreement”) with a qualified Labor Relations contractor with experience to support the University’s collective bargaining efforts as requested and as directed by the University. Proposer must have significant experience providing Labor Relations and Collective Bargaining guidance and advice to large, complex, unionized, and multi-location organizations with a diverse and unique employee population. Proposer must have significant experience negotiating on behalf of an employer's multi-year collective bargaining agreements. Prior to commencement of Services, Contractor must fully understand and appreciate the importance of Collective Bargaining, the historical context of Collective Bargaining within the City University of New York while balancing the need to clearly and fully advocate on behalf of the City University of
New York, its constituents, and the community in which it serves. To the extent Contractor does not have such knowledge prior to the start of the Term of the Contract, Contractor shall promptly familiarize itself with such information so as to begin providing Services without delay. The University is not seeking legal representation, nor a Contractor to provide legal services. A Proposer may be an attorney or a law firm to provide labor relations services that are unrelated to the provision of legal services or legal counsel, however such Proposers must clearly indicate in their Proposal that they will be providing labor relations services and not legal services. The selected Contractor shall not have an attorney-client relationship with the University and shall not be acting in the capacity of the University’s attorney or providing legal services. The Procurement Lobbying Act (PLA) Applies to this Solicitation. The restricted period has begun. Compliance Procurement Lobbying Act Required Forms: Vendor shall complete, sign and submit the following forms if they are selected. 1. “Offerer’s Affirmation of Understanding of and Agreement pursuant to State Finance Law § 139-j (3) and § 139-j (6) (b)” 2. “Offerer’s Disclosure of Prior Non-Responsibility Determinations and Certification of Compliance with State Finance Law §139-j and §139-k”. Under the requirements of the State Procurement Lobbying Act all communications regarding advertised projects are to be channeled through the Office of the Executive Director of Strategic Sourcing and Chief Procurement Officer (*Designated Contacts). Until a designation is made, communication with any other CUNY employees concerning this project that is determined to be an attempt to influence the procurement may result in disqualification. Contact with CUNY: Under the requirements of the PLA, all communications regarding advertised projects are to be channeled through the Designated Contact. Communication with respect to this procurement initiated by or on behalf of an interested vendor through others than the Designated Contact may constitute an “impermissible contact” under NYS law and could result in disqualification of that vendor.
