The Department of Veterans Affairs, Network Contracting Office 9, hereby provides notice of its intent to sole-source award to Johnston Technologies, 130 Seaboard Lane, Suite A-13 Franklin, TN 37067, firm-fixed-price contract, for a 4-year period. The contract is expected to be awarded under FAR 13.106-1(b). A Justification and Approval for Other Than Full and Open Competition will be prepared. The period of performance shall be 3/11/2023 3/10/2027. The contract will provide services and maintenance for Uninterrupted Power Supply (UPS) system service for Eaton 9390-100-120, VRLA Sealed, 40 equipment at the Nashville VA Medical Center located at 1310 24th Avenue South Nashville, TN 37212. NAICS code: 811210 Electronic and Precision Equipment Repair and Maintenance. (SBA Size Standard 34 million). Johnston Technology has proprietary authorization to perform maintenance on Eaton 9390-100-120, VRLA Sealed, and 40 equipment Services. As a result, any contractor other than Johnston
Technologies that would be allowed to work on, maintain, and/or tamper with the current system in any capacity would void the warranty of the Eaton equipment. Voidability of said warranty cannot be permitted. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, interested parties may identify their interest and capability that provides clear and convincing evidence that the current warranty provided by Johnston Technologies for Eaton equipment will not be voided by having a contractor other than Johnston Technologies conduct the above-referenced maintenance to respond to this requirement no later than February 6th, 2023, at 8:00 Central Time (CT). A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement. The Department of Veterans Affairs will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM) to be eligible for award. Interested parties are encouraged to furnish information by email only with RESPONSE TO INTENT TO Eaton Equipment Support Service in the subject line no later than February 6th, 2023, at 8:00 Central Time (CT). All documents submitted will not be returned.
